RUSSELL, TRANSIT DIRECTOR SUBJECT: P.R. NO. 17304 - CHANGE ORDER FOR NELSON COLLABORATIVE SERVICES WITH PAT DATE: 10/04/2012 RECOMMENDATION: Recommend that Proposed Resolution No. 17304 be approved so that the design and bids may be accepted in line with this contract and work on the renovation of PAT's complex can continue. BACKGROUND: The City of Port Arthur desires to execute a change order for the Architects, The Nelson Collaborative, to design a fire system for Transit's complex. The system was originally overlooked, but with the Building Storage codes of the International Code Council mandates this system by Law. This Agreement, entered into as of October 2012, between the City of Port Arthur and The Nelson Collaborative for professional services for Port Arthur Transit renovations will increase their fees from $72,000 to $86,415.31 BUDGETARY /FISCAL EFFECT: The total remaining compensation for The Nelson Collaborative will be from the American Recovery and Reinvestment Act (ARRA). This amount shall be from TX90 -X040 that are Federal Transit Administration allocated funds. These funds in account 402 - 1508 - 54.561.00 are 100% reimbursable. STAFFING /EMPLOYEE EFFECT: With these changes the employees and shared assets of the Port Arthur Transit Department and FTA will be under Code compliance. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER 01 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND THE NELSON COLLABORATIVE FOR DESIGN OF ADDITIONAL FIRE SAFETY EQUIPMENT, INCREASING THE CONTRACT AMOUNT BY $14,415.31 TO A NEW TOTAL OF $86,415.31; FUNDED FROM FEDERAL TRANSIT ADMINISTRATION ALLOCATED FUNDS — ARRA TX90 -X040 WHEREAS, per Resolution No. 11 -084, the City entered into a contract with The Nelson Collaborative ( "Nelson ") for the design and oversight of the renovations of the Transit Service Building and Transfer Center; and WHEREAS, per Resolution No. 12 -286, "Nelson" was granted a ten (10) month extension; and WHEREAS, during the rebid of the project, it was determined that additional design for fire safety components were required to be Code compliant, see explanation from Timothy Barnes attached as Exhibit "A "; and WHEREAS, approval of Change Order 01 increasing the contract amount by $14,415.31 to a new total of $86,415.31, funded from Federal Transit Administration allocated funds for ARRA (America Recovery and Reinvestment Amendment) funds and these fees are 100 %, is herein deemed appropriate. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. NO. 17304 09 /21 /12CWR Page 2 THAT the facts and opinions in the preamble are true and correct. THAT Change Order 01 is herein approved and the City Manager is authorized to execute said Change Order, in substantially the same form as attached hereto as Exhibit `B ". THAT the payments are 100% reimbursable to the City by FTA from Account No. 402- 1508- 561.54 -00, which is an ARRA account. THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council. As was stated during the meeting and confirmed by both Butch Haas (Senior Building Inspector) and Mark Mulliner (Fire Marshal), the original scope of work was not required to include a fire suppression system under the 2006 International Building Code as adopted and used by the City of Port Arthur during the design and review of the project at the time. The original project received a permit in full compliance with the city's building code requirements and construction had begun. While it was determined the project would have to be re -bid to meet the demands of the FTA, the Transit Department requested the design team utilize that time to include a few additional scope of work items as part of the revised bid documents to be issued to potential bidders. The inclusion of the new automatic fire suppression system in the renovation of the Transit Service Building was included during the re- bidding period in response to city moving to adopt the 2012 International Building Code for all future projects. The bid documents as issued on July 30, 2012 to the general contractors and resubmitted for permit includes the new fire suppression system along with other requested additional scope of work items by the city. As part of our previous construction administration services to the City of Port Arthur for the Service Building, the design team reviewed all systems and products proposed by the general contractor to be used and/or installed on this project to ensure full compliance with the Federal Buy America Clause, the drawings and specifications. A record copy of the products is kept in our office and an additional copy is transmitted to the Transit Department for their record, and a final copy is kept by the general contractor on site for review at any time. This process will continue in earnest once construction starts again.
