BACKGROUND:
The Planning and Zoning Commission is being asked to consider the recommendation of
approval for an Oil or Gas Drilling Permit # 171, to be located
On Tuesday, October 23, 2012, notice was published in the Port Arthur News stating the
intension of Tri -C Resources, LLC to drill, complete and operate an oil and /or gas well described
as the Cornelia Marie #1, exploratory well, located in the north half of the west half of Lot 6,
Block 7, Range "G," Port Arthur Land Company Subdivision, City of Port Arthur, Jefferson County,
Texas. The above location describes where the drilling rig will be established in the vacant lot
between Central Baptist Church, 4545 Hwy 73 and Five Points Federal Credit Union, 4401 Hwy
73, and located southwest of 46th Street and Wal -Mart, 4999 N Twin City Hwy. The directional
drilling objective is the Lower Hackberry formation at a total true vertical depth of 11,700 feet.
The bottom hole location is expected to be located on northwest of the Wal -Mart property, some
1,188 feet from the surface drilling site. The anticipated actual drilling time is about 30 days.
Tri-C's application meets all the requirements of Chapter 66, Article I, Section 66 -1 through 66-
24 of the Port Arthur Code of Ordinances. The company has posted two surety bonds in the
amount of $25,000 as required by Section 66 and $450,000 as required by Section 106 -7 & 8,
Heavy Haul Permit.
Applicant — Tri - C Resources LLC; Owner - First Baptist Church of Port Arthur
RECOMMENDATION: The Planning staff has no objections to the approval of this drilling permit.
BUDGETARY /FISCAL EFFECT: None
STAFFING /EMPLOYEE EFFECT: None
SUMMARY: The applicant meets all requirements set forth in city ordinance; thereby, staff rec-
ommends approval of drilling permit request.

The Planning and Zoning Commission met in Regular Session on Monday, October 15, 2012 at 5:30
p.m. in the City Council Chamber, City Hall, with the following members present: Chairman Richard
Cox; Commissioners: Alma LeBlanc, Inell Moore, Fernando Ramirez and Norris Simon
Staff present: Ronald Burton, director of planning and Paul Brown, sr. planner
II. PUBLIC HEARING
A. Z12 -08 - ZONING DISTRICT CHANGE REQUESTED FOR - 96.21 ACRES OF LAND OUT OF AND
PART OF LOTS 1, 2, 7 AND 8, BLOCK 4. RANGE "B" AND LOTS 1 AND 2, BLOCK 5. RANGE "B ",
PORT ARTHUR LAND COMPANY SUBDIVISION, CITY OF PORT ARTHUR, JEFFERSON COUNTY,
TEXAS (PROPERTY LOCATED NORTH OF TEXAS 87/73 ON THE WESTSIDE OF F.M. 366)
The Chairman introduced the above - mentioned zoning district change request.
Planning and Zoning Director Ronald Burton gave an overview of the above - mentioned
zoning district change request.
The Commission opened the meeting to hear from anyone present in the audience who
wished to speak regarding the above - mentioned request:

unanimously, the Planning and Zoning Commission closed the Public Hearing.
III. ITEMS REQUIRING ACTION
A. APPROVAL OF ZONING DISTRICT CHANGE REQUEST
Planning and Zoning Director Ronald Burton recommended that zoning district change
request Z12 -08 be granted utilizing one of the following options:
1. Approve zoning district change request; or
2. Grant an extension of the current SUP with stipulations
The motion was made by Commissioner Ramirez, seconded by Commissioner Simon to
accept the Planning Staffs recommendation to approve zoning district change request
Z12 -08 with the following stipulations:

1. Maintain the current SUP with the following provisions:
a. Grant a ten (10) year extension to begin on January 29, 2013 to
allow for current use and provisions.
b. Include language to allow for the temporary use of manufactured
office buildings and establish restrictions against permanent
welding and machine shop activities.

Voting No: None.
IV. MINUTES - OCTOBER 1, 2012
Commissioner Moore requested that the following correction be made to the Minutes of October
1, 2012:
• Change wording in the document from "...Commission to hear from anyone
present... " to read "...Commission opened the meeting to hear from anyone
present..."
Upon the motion of Commissioner Moore, seconded by Commissioner Simon and carried
unanimously, the Planning and Zoning Commission approved the above - mentioned minutes
with correction.
