Saunders, Civic Center Director DATE: 11/19/12 SUBJECT: Proposed Resolution No. 17412 RECOMMENDATION The Civic Center request the City Council's approval to enter the City of Port Arthur into a contract with Intex Flooring, of Houston, Texas for demolition and installation of flooring in the lobby of the Robert A "Bob" Bowers Civic Center in the amount of $51,575. BACKGROUND The price is done on Texas Multiple Award Schedule Programs (TXMAS) pricing, where the State and the Federal Government have competitively awarded these contracts, and no other pricing is required. BUDGETARY AND FISCAL EFFECT Charge to Account Number 001 - 1061 - 518.32 -00. STAFFING EFFECT None SUMMARY The Civic Center request the City Council's approval to enter the City of Port Arthur into a contract with Intex Flooring, of Houston, Texas for demolition and installation of flooring in the Lobby of the Robert A "Bob" Bowers Civic Center in the amount of $51,575.00. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH INTEX FLOORING OF HOUSTON, TEXAS, FOR DEMOLITION AND INSTALLATION OF FLOORING IN THE LOBBY OF THE ROBERT A "BOB" BOWERS CIVIC CENTER IN THE AMOUNT OF $51,575; FUNDING AVAILABLE IN ACCOUNT NO. 001 - 1061 - 518.32 -00 WHEREAS, the Civic Center Lobby floor is in need of repair due to the tile coming up in several locations; and, WHEREAS, the Civic Center Lobby floor damage has become a tripping hazard and it is in the best interest of the City to have it repaired; and, WHEREAS, Intex Flooring of Houston, Texas, agrees to demolish the existing tile flooring and replace with new flooring at a cost of $51,575; and, WHEREAS, the Civic Center Lobby flooring project is procured through (TXMAS) Texas Multiple Award Schedule Programs, where the State and the Federal Government have competitively awarded these contracts; and, WHEREAS, the City Council deems it is in the best interest of the City to enter into a contract with Intex Flooring of Houston, Texas for demolition and installation of flooring of the lobby of the Robert A "Bob" Bowers Civic Center in the amount of $51,575. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct. THAT, the City Council authorizes the City Manager to enter into a contract with Intex Flooring, of Houston, Texas, for demolition and installation of flooring in the Lobby of the Robert A "Bob" Bowers Civic Center in the amount of $51,575, in substantially the same form as attached as Exhibit "A ". THAT, an authorized representative of Intex Flooring of Houston, Texas, shall sign this Resolution agreeing to the terms hereof. THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council. P. R. NO. 17412 11/19/12 AJS PAGE 3 AGREED TO: INTEX FLOORING By: Print Name: Title: EXHIBIT "A" CONTRACT FOR DEMOLITION AND REPLACEMENT OF TILE FLOORING AT ROBERT A "BOB" BOWERS CIVIC CENTER LOBBY THIS AGREEMENT, made this day of November, 2012, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY ", and by and through Intex Flooring of Houston, Texas, hereinafter called "CONTRACTOR ". WITNESSETH: That, for and in consideration of, the payment terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The work to be performed under this Contract will be completed within 30 days after the start date on the Notice to Proceed. 2. The CONTRACTOR will perform the work as delineated in the Scope of Work, which is included in the Project Proposal, and Specifications attached hereto. 3. During the term of this Contract, the Contractor will furnish at this own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications and Scope of Work noted in the Project Proposal. 4. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the following amount of $51,575. 5. The CONTRACTOR will commence the work required by the Contract Documents upon Receipt of a Notice to Proceed. 6. The term "Contract Documents" means and includes the following" a. Agreement b. Change Orders: Any work not included in the above scope of work will require a signed change order before work can be performed. JJ 1 2. Term of Quote: Prices given are firm for thirty days from proposal date. 3. Lead Times: Please note that lead times vary depending upon final selection and initial production will not begin until we have a signed purchase order, or a FULLY - EXECUTED contract in house. Note that normal lead times are as follows for carpet: • Fast Track/ Quick Ship Carpets, two weeks plus shipping; • Running Line Carpets, six weeks plus shipping; • Custom Carpets, eight weeks plus shipping; • Lead times are approximate and do not start until after the purchase order or fully- executed contract is received. 4. Floor Preparation: Additional floor preparation may be required as a result of an unforeseen condition of the floor. Costs associated with this floor preparation will be negotiated on a job-to-job basis. Our product performs properly when installed on floors that are free of DIRT, OIL, PAINT AND EXCESSIVE MOISTURE. Floors that have moisture readings greater than 3.0 lbs. per 1,000 feet in 24 hours will not meet specification and will require further curing time or treatment prior to carpet installation. Intex recommends only wet scraping or mechanical removal of all non -water based adhesives. 5. Asbestos Abatement: This quote DOES NOT include asbestos abatement. Intex is not responsible for the handling, removal or abatement of asbestos contained floor material or adhesive. Further, Intex's policy is to request an Asbestos Hazard Emergency Response Act (AHERA) report prior to proceeding with any floor material or floor adhesive removal. Intex considers it the owner's responsibility to produce this report prior to executing this contract. If any chemical stripping agents such as those commonly used in asbestos abatement have been used, Intex may require additional measures be taken prior to installation of any flooring product.
