Attached is P. O. No. 5611 canvassing the returns and
declaring the results of a General and Special Election held in the
City of Port Arthur on Saturday, the 13th of May, A.D., 2006; a
General Election for the purpose of electing councilmembers from
Districts 5 and 6, as well as for the purpose of electing
councilmembers for Positions 7 and 8; and a Special Election as to
propositions on the legal sale of mixed beverages in restaurants by
food and beverage certificate holders only; as to amending the City
Charter; as to whether or not the existing Section 4A Sales Tax
shall be utilized for various categories of projects as described
in Section 4B of Article 5190.6, Vernon's Texas Code Annotated; and
as to sell Fairlea Park. I have also orally contacted the Justice
Department to notify them of the election results.

WHEREAS, on February 14, 2006, the City Council adopted
Ordinance No. 06-05 that called for a General Election for the
purpose of electing Councilmembers from Districts 5 and 6, as well
as for the purpose of electing councilmembers for Positions 7 and
8; and
WHEREAS, on February 14, 2006, the City Council adopted
Ordinance No. 06-07 that called a Special Election on May 13, 2006,
for the purpose of submitting a proposition as to the legal sale of
mixed beverages in restaurants by Food and Beverage Certificate
Holders only; and
WHEREAS, on February 14, 2006, the City Council adopted
Ordinance No. 06-08 that called for a Special Election on May 13,
2006, for the purpose of submitting propositions as to amending the
City Charter; and
W~EREAS, Section 19 of Ordinance No. 06-08 stated that the
charter changes involving a new standard, practice, or procedure
will not be effective until the Attorney General (Justice
Department) interposes a "no" objection letter or a Declaratory
Judgment is obtained; and
W~ZREAS, on February 14, 2006, the City Council adopted
Ordinance No. 06-09 that called for a Special Election on May 13,
2006, for the purpose of submitting a proposition as to sell
Fairlea Park; and
W~ERZAS, on February 28, 2006, the City Council adopted
Ordinance No. 06-10 that called a Special Election on May 13, 2006,
for the purpose of submitting propositions as to whether or not
the existing Section 4A Sales Tax shall be utilized for various
categories of projects as described in Section 4B of Article
5190.6, Vernon's Texas Code Annotated; and
W~ER~AS, on March 14, 2006, the City Council adopted Ordinance
No. 06-15 which designated the Sabine Pass Fire Station No. 4 as
one of the official voting locations instead of the Sabine Pass
High School for the May 13, 2006 Elections.
W~ER~AS, in accordance with the Charter of the City of Port
Arthur, and the laws of the State of Texas applicable thereto, a
General Election and a Special Election were held on Saturday, May
13, 2006, A.D., in the precincts into which the City of Port Arthur

is divided for voting purposes; and
W~ER~AS, said election was held for the purpose of allowing
the qualified voters to elect Councilmembers from Districts 5 and
6, as well as for the purpose of electing councilmembers for
Positions 7 and 8; submitting propositions as to the legal sale of
mixed beverages in restaurants by food and beverage certificate
holders only; as to amending the City Charter; as to whether or not
the existing Section 4A Sales Tax shall be utilized for various
categories of projects as described in Section 4B of Article
5190.6, Vernon's Texas Code Annotated; and as to sell Fairlea Park;
and providing for publication of the election notice, as denoted
herein, and with a copy of the Order of the Election being attached
as Exhibit

the propositions were as follows:
PROPOSITION NO. ONE:
Election Code 501.035
"The legal sale of mixed beverages in restaurants by food and
beverage certificate holders only."
PROPOSITION NO. TWO:
Shall the last line of Section 1 of Article II of the City
Charter be deleted as to remove the prohibition that neither
the Mayor nor any Councilmember shall serve more than three
(3) consecutive terms in the same office.
PROPOSITION NO. THREE:
Shall Section lA of Article II of the City Charter be
amended as follows:
"Section lA. Council Positions 7 and 8
Until May 2008, Council Positions 7 and 8
shall have two (2) year terms. The elections
of Council Positions 7 and 8 shall be in the
year 2008 and thereafter by a majority vote,
and they shall have three (3) year terms.
This provision supercedes any conflicting
portion of the City Charter in relation to
the election of Council Positions 7 and 8."
PROPOSITION NO. FOUR:
Shall Section 7 of Article XIV of the City Charter be
amended as follows:
"Section ?. Sale or Lease of Property.
No right, title or interest of the City and to
any property shall be sold or leased unless
authorized by the City Council by a Resolution

if it is a lease and by an ordinance if it is
a sale."
pROPOSITION NO. FIVE:
Shall the fourth sentence of Section i of Article XIV
of the City Charter be amended as follows:
~All contracts for expenditures shall be
authorized in accordance with the minimum
standards as delineated under state law."
pROPOSITION NO. SIX=
Shall the first two sentences of Section 3 of Article II
of the City Charter be amended as it pertains to
salaries and car allowances for the Mayor and City
Council.
~The Mayor and Councilmembers shall receive a
salary and car allowance as delineated in an
Ordinance set by the City Council at such time
as they approve the fiscal year budget for the
City, with due opportunity for public
comment."
PROPOSITION NO. SEVEN:
Shall the City Council be authorized to sell, and by
proper instrument in writing, convey to such person, or
persons whom the City Council deems advisable, and upon
such terms and conditions as said City Council may deem
advisable and proper, certain property being more
particularly described as follows: the park land at
Fairlea Addition.
PROPOSITION NO. EIGHT:
For the next two years, shall the existing Section 4A
Sales and Use Tax within the City of Port Arthur be
utilized for amateur sports, and athletic purposes and
events, including ball parks, soccer fields, football
fields, and related concession, and facilities, which is
a category of projects under Section 4B of Article
5190.6 Vernon's Texas Code Statutes, with the condition

that total annual spending on all Section 4B projects by
the City of Port Arthur Section 4A Economic Development
Corporation will not exceed $500,000 per year. Said
period of time can be extended an additional two years
by the City Council by a 2/3 vote of the City Council
after receiving public comment of the proposed cost and
impact of the projects.
PROPOSITION NO. NINE:
For the next two years, shall the existing Section 4A
Sales and Use Tax within the City of Port Arthur be
utilized to promote or develop new or expanded business
enterprises that create or retain primary jobs, including
a project to provide demolition of existing structures,
which is a category of projects under Section 4B of
Article 5190.6 Vernon's Texas Code Statutes, with the
condition that total annual spending on all Section 4B
projects by the City of Port Arthur Section 4A Economic
Development Corporation will not exceed $500,000 per
year. Said period of time can be extended an additional
two years by the City Council by a 2/3 vote of the City
Council after receiving public comment of the proposed
cost and impact of the projects.
WHEREAS, the sealed returns of said election for the
Councilmembers from Districts 5 and 6, and for the Council
Positions 7 and 8, as well as for Propositions Numbered One through
Nine, have been duly made to the City Council of the City of Port
Arthur, and the City Council has examined said returns.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. That the polling places were provided for the

precincts into which the City is divided for voting purposes and
said Election was held herein by the City Secretary. Early voting
was conducted at the following locations:

Section 3. That the sealed returns of said General and
Special Election, after being canvassed by the City Council, are
found and declared to be true and correct. There were cast, at
said election for the respective candidates and propositions, the
number of votes as shown on the tabulated statements attached
hereto and made part hereof as Exhibit "B".
Section 4. That the City Council has determined that said
General Election was duly called, ordered, and held in accordance
with the Laws of the State of Texas and the Charter of the City of
Port Arthur; and that Ordinance No. 06-05, the Order ordering the
General Election, and the returns thereof, have been made by the
proper official, and that the election resulted in the election of

duly qualified and shall expire in May 2009 or until his/her
successor has been elected and duly qualified. That the terms for
the Councilmembers for Positions 7 and 8 shall commence on the date
that the candidate is duly qualified, and shall expire in May 2008 or
until his/her successor has been elected and duly qualified.
Section 5. That City Council shall therefore be composed

Section 6. That the City Council has determined that said
Special Election was duly called, ordered, and held in accordance
with the Laws of the State of Texas and the Charter of the City of
Port Arthur; and that Ordinance No. 06-07, 06-08, 06-09, and 06-10,
the Orders ordering the Special Election, and the returns thereof,
have been made by the proper official, and that the election resulted
in the following:

passed. The City Secretary shall send a certified copy of this
Ordinance to the County Clerk of Jefferson and Orange County.
Section 9. That since Proposition No. 3 was adopted,
Section lA of Article II of the City Charter is herein amended to
read as follows:
ARTICLE II. THE COUNCIL
Section lA. Council Positions 7 and 8.
"Until May 2008, Council Positions 7 and 8 shall have two
(2) year terms. The elections of Council Positions 7 and
8 shall be in the year 2008 and thereafter by a majority
vote, and they shall have three (3) year terms. This
provision supersedes any conflicting portion of the City
Charter in relation to the election of Council Positions
7 and 8."
Section 10. That since Proposition No. 6 was adopted,
Section 3 of Article II of the City Charter is herein amended to
read as follows:
ARTICLE II. THE COUNCIL
Section 3. Salary and Expenses.
"The Mayor and Councilmembers shall receive a
salary and car allowance as delineated in an
Ordinance set by the City Council at such time as
they approve the fiscal year budget for the City,
with due opportunity for public comment. They
shall also be entitled to be reimbursed for all
other necessary expenses incurred in the
performance of their official duties. The requests
for reimbursement for expenses incurred shall be
presented and approved by the City Council in an
official public meeting in accordance with the
City's policies and procedures as adopted or to be
adopted by Ordinance."
Section 11. That since Proposition No. 5 was adopted,
Section 1 of Article XIV of the City Charter is herein amended to
read as follows:
ARTICLE XIV. MUNICIPAL CONTRACTS
Section 1. Purchase Procedure.
~All purchase contracts made shall be pursuant to a
requisition from the head of the office, department, or
agency whose appropriation will be charged, and no
contract or order shall be binding upon the City unless
and until the Director of Finance certifies that there is
to the credit of such office, department, or agency a
sufficient unencumbered appropriation and allotment
balance to pay for the supplies, materials, equipment, or
contractual services for which the contract or order is
to be issued. Before the City makes any purchases for
supplies, materials, equipment, or contractual services,
opportunity shall be given for competition. The Council
may, by Ordinance, confer upon the City Manager general
authority to contract for expenditure without further
approval of the Council for all budgeted items not
exceeding Five Thousand Dollars ($5000.00); subject to
the requirement that a monthly check register indicating
all such expenditures be provided to the Council. All
contracts for expenditures shall be authorized in
accordance with the minimum standards as delineated under
state law. Contracts for professional services shall not
be let on competitive bids. All contracts for public work
shall be signed by the Mayor, City Manager, attested by
the City Secretary, and the corporate seal of the City
affixed thereto, after approval thereof by the City
Council; provided, however, this provision may be waived
where there is a public calamity, the necessities of
citizens, or the preservation of the property of the City
so demand; or, where the City contracts with the County
or State for construction of public improvements."
Section 12. That since Proposition No. 4 was adopted,
Section 7 of Article XIV of the City Charter is herein amended to
read as follows:

Section 13. That the City Secretary shall send a certified
copy of this Ordinance to the City of Port Arthur Section 4A
Economic Development Corporation notifying them that Propositions
No. 8 and No. 9, as to the usage of Section 4A Sales Tax for
various categories of projects as described in Section 4B, was
adopted so that moneys can be utilized for amateur sports and
athletic purposes and events, including ball parks, soccer fields,
football fields, and related concessions and facilities, as well as
for the promotion or development of new or expanded business
enterprises that create or retain primary jobs, including projects
to provide demolition of existing structures as more fully
described in said propositions.
Section 14. That the City Attorney shall send a copy of
this Ordinance to the Justice Department.
Section 15. That this being an Ordinance for which
publication is not required under the Charter of the City of Port
Arthur, it shall not be published, but shall take effect and be in
force immediately from and after its passage, except as noted for
any charter changes that were objected to in the letter from the
Justice Department attached hereto as Exhibit "C".
Section 16. That a copy of the caption of this Ordinance be
spread upon the Minutes of the City Council.

PROPOSITION NO. 1 .'
Election Code 501.035
"The legal sale of mixed beverages in restaurants by food and'
beverage certificate holders only."
PROPOSITION NO. 2:
Shall the last line of Section i of Article II of the City
Charter be deleted as- to remove the prohibition that neither the
Mayor nor any Councitmember shall serve more than three (3)
consecutive terms in the same office.
PROPOSITION NO. 3:
Shall Section IA of Article II of the City Charter be amended as
follows:
~Section lA. Council Positions 7 and 8
Until May 2008~ Council Positions 7 and 8 shall
have tw~ '(2) year terms. The elections of
Council Positions 7 and 8 shall he in the year .
2008 and thereafter by a majority, vote, and
they shall have three (3) year terms. This
provision supercedes any conflicting portion of
the City Charter in relation to the election of
CouNcil Positions 7 and 8."
PROPOSITION NO. 4:
Shall Section 7 of Article XIV of the City Charter be
amended as follows:
~Section 7. Sale or Lease of Property.
No right, title or interest of the City and to -~r
any property shall be sold or leased unless
authorized by the City Council by a Resolution if
it is a lease and by an Ordinance if it is a
sale."
PROPOSITION NO. 5:
Shall the fourth sentence of Section 1 of Article XIV of
z.combined order and notice of elections
~All contracts for expenditures shall be
authorfzed in accordance with the minimum
standards as delineated under state law."
PROPOSITION NO. 6:
Shall the first two sentences of Section 3 of Article II of
the City Charter be amended as it pertains to salaries and
car allowances for the Mayor and City Council.
"The Mayor and Councilmembers shall receive a
salary and car allowance as delineated in an
Ordinanc~ set by the City Council at such time as
they approve the fiscal year budget for the City;
with due opportunity for public comment."'
PROPOSITION NO. 7:
Shall the City Council be authorized to sell, and by proper
instrument in writing, convey to such person, or persons
whom the City Council deems advisable, and ~pon such terms
and conditions as said City Council may deem advisable and
proper, certain property being more particularly described
as follows: the park land at Fairlea Addition.
PROPOSITION NO. 8:
For the next two years, shall the existing Section 4A .Sales
and Use Tax within the City of Port Arthur be utilized for
amateur sports, and athletic purposes and events, including
ball parks, socce~ fields, football fields, and related
concession, and facilities, which is a category of projects
under Section 4B of Article. 5190.6 Vernon's Texas Code
Statutes, with the condition that total annual spending on
all Section 4B projects by the City of Port Arthur Section
4A Economic Development Corporation will not exceed
$500,000 per year. Said period of time can be extended an
additional two years by the City Council by a 2/3 vote of.

PROPOSITION NO. 9:
