LOCATED AT 725 E. PROCTER STREET; AND AUTHORIZING A PAYMENT
TO LARK GROUP, INC. IN THE AMOUNT OF $14,750.00, UPON
COMPLETION OF THE PROJECT
COMMENT
RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 17437
authorizing the emergency asbestos abatement /demolition a dangerous commercial property located
at 725 E. Procter Street, and authorizing a payment to Lark Group, Inc. in the amount of
$14,750.00 upon completion of the project.
BACKGROUND: The commercial structure located at 725 E. Procter Street is in imminent danger
of collapse because of a large crack at the top of the front wall, and as a result, it is necessary to
immediately perform emergency demolition of the building per Section 108, Unsafe Structures, of
the 2006 International Property Maintenance Code. Lark Group, Inc. was the lowest responsible
bidder, and was contracted to perform the emergency asbestos abatement and demolition of the
structure. Please find attached my memo to the City Manager which gives a summary of the events.
Our consultant, ICU Environmental, Health & Safety secured four (4) emergency quotes for this
work. Lark Group, Inc. is the lowest, most responsive bidder; their bid was $14,750.00. C &C
Demo, Inc. bid $15,125.00; AAR, Inc. bid $19,550.00, and Inland Environments, Ltd bid
$28,880.00. Bid award is based on the lowest and most responsive bid.
BUDGET AND REVENUE IMPACT: Acceptance of this recommendation will not require a
budget amendment. Funding is available in Account No. 303 - 1603 - 591.59 -00; Project No. CIP614
(EDC).
STAFF LEVEL IMPACT: Acceptance of this recommendation will have no effect on current
staffing level.
SUMMARY: Staff recommends that the City Council adopt P. R. No. 17437, thereby authorizing a
payment to Lark Group, Inc. in the amount of $14,750.00.

Re: Emergency Demolition of 725 Procter Street
As a result of a large crack on the front wall of this
structure I am concerned that it could collapse and injure a
citizen. The crack is becoming bigger and the wall has begun
to pull away for the main building.
Therefore I am hoping Council will allow staff to move forward
with the demolition of this structure and remove this
potential dangerous situation. This area is close to two
businesses and could pose a hazard to the patrons who
patronize these facilities.
We have submitted a resolution P.R.17437, to Council
requesting authorization to award a contract to Lark
Demolition for an emergency demolition. Staff has taken the
steps needed to insure we comply with all Texas Department of
Health regulations. We are ready to move forward once Council
gives its approval.
Based on our codes this structure poses an imminent danger as
defined by our Property Maintenance Code in Section {A} 109.2.

A RESOLUTION AUTHORIZING THE EMERGENCY ASBESTOS
ABATEMENT /DEMOLITION OF A DANGEROUS COMMERCIAL
PROPERTY LOCATED AT 725 E. PROCTER STREET (BUILDING
A); AND AUTHORIZING A PAYMENT TO LARK GROUP, INC. IN
THE AMOUNT OF $14,750, UPON COMPLETION OF THE
PROJECT, TO BE CHARGED TO ACCOUNT NO. 303-1603-591.59-00;
PROJECT NO. CIP614.
WHEREAS, a commercial structure located at 725 E. Procter Street (Building A) is in imminent danger of
collapse because of a large crack in the front wall of the building, and as a result, it is necessary to perform an
emergency demolition of the building per Section 108, Unsafe Structures, of the 2006 International Property
Maintenance Code; and
WHEREAS, this situation constitutes an emergency procurement under Texas Local Government Code
252.022, Section (2), "a procurement necessary to preserve or protect the public health or safety of the
municipality's residents "; and,
WHEREAS, quotes were solicited from four contractors for emergency demolition;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT Lark Group, Inc. was the lowest responsible bidder, and was contracted to perform the
emergency asbestos abatement and demolition of the structure; and
THAT the City Council of the City of Port Arthur hereby authorizes payment in the amount of
$14,750.00, for the emergency asbestos abatement and partial demolition of a commercial property located at 725
E. Procter Street (Building A) to Lark Group, Inc., upon completion of the project; and,
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
READ, ADOPTED, AND APPROVED this the 11th day of December, A.D., 2012, at a Regular
Meeting of the City Council of the City of Port Arthur, Texas by the following vote:
