Mr. Burton:
This letter is sent at the request of Mr. Harold J. Garcia and Mrs. Betty A. Garcia with
regards to a Site Plan for the operation of an event center located at 3648 39 Street, Port
Arthur, Texas. The original Site Plan had previously been rejected and denied by
Council after being approved by the Zoning Board.
Mr. & Mrs. Garcia beseech you, as the Planning Director, on their behalf to request
Council reconsider their ruling and approve the revised Site Plan (see attached). The
revised Site Plan reflects traffic flow from 39 Street through the Site and onto 9th
Avenue, which we believe will eliminate any traffic congestion for which the neighbors
may have a concern. Also attached is a copy of the Schedule of Events that would take
place at this facility.

24 -100. - Initiation of changes.
24 -100. - Initiation of changes.
Any person or corporation having a proprietary interest in any property may petition the city council for
a change or amendment to the provisions of this ordinance. The planning and zoning commission may
on its own motion or on request from the city council institute study and proposal for changes and
amendments in the public interest.
24 -101. Types of changes permitted.
The city council may, from time to time, amend, supplement or change by ordinance, the boundaries of
the districts or the regulations herein established as provided by the statues of the State of Texas.
24 -102. Changes to be considered by planning and zoning commission first, then by council.
Before taking action on any proposed amendment, supplement or change, the council shall submit the
same to the planning and zoning commission for its recommendation and report. The commission may
recommend that the amendment be approved as requested, or it may recommend a more restrictive
amendment than that requested in accordance with section 7, or it may recommend that the
amendment be denied.
24 -103. Notification requirements.
The planning and zoning commission shall hold a public hearing on any application for any amendment
or change prior to making its recommendation and report to the city council. When any such
amendment or change relates to a change in classification or boundary of a zoning district, written
notice of public hearing before the planning and zoning commission on the proposed amendment or
change shall be mailed to all owners of real property Tying within 200 feet of the property on which the
change is requested. Such notice shall be given not Tess then ten days before the date set for hearing
by depositing in the mail such notice, properly addressed and postage paid, to each taxpayer as the
ownership appears on the last approved city tax roll. When any such amendment relates to a change of
a zoning regulation or to the text of this ordinance not affecting specific property, notice of the public
hearing of the planning and zoning commission shall be given by publication in a newspaper of general
circulation in the City of Port Arthur without the necessity of notifying property owners by mail. Such
notice shall state the time and place of such hearing and the nature of the subject to be considered,
which time shall not be earlier then ten days from the date of publication.
24 -104. Public hearing requirements.
A public hearing shall be held by the city council before adopting any proposed amendment,
supplement or change. Notice of such hearing shall be given by publication in a newspaper of general
circulation in the City of Port Arthur stating the time and place of such hearing, which time shall not be

earlier than 15 days from the date of publication. The city council hearing may be conducted as a joint
hearing with the planning and zoning commission in accordance with the provisions of V.T.C.A., Local
Government Code § 211.007.
24 -105. Three - fourths council vote required under some circumstances.
Unless a proposed amendment, supplement or change has been approved by the planning and zoning
commission, or if a protest against such proposed amendment, supplement or change has been filed
with the city secretary, duly signed and acknowledged by the owners of 20 percent or more, either of
the area of the lots or land included in such proposed changes, or of the lots or land immediately
adjoining the same and extending 200 feet therefrom, such amendment shall not become effective
except by the favorable vote of three - fourths of all the members of the city council.
24 -106. Possible administrative fees.
The city council may, by separate ordinance or ordinances, provide for fees to be paid by a petitioner to
cover the administrative and advertising costs related to petitions for amendment or change to this
ordinance.
24 -107. Limitations on reapplications.
When the city council has denied a proposal, or when an application has been withdrawn at or before
the commission meeting thereon and after giving of public notice, no new applications of like nature
shall be accepted by the city or scheduled for hearing by the commission within a period of 12 months
of the date of council denial or withdrawal of application; provided, however, on receipt of written
request by the original applicant stating how conditions have changed substantially in the community
since consideration of the prior proposal so as to justify an earlier review of this matter, the planning
and zoning commission may waive the mandatory delay period and authorize acceptance of a new
application.
