RECOMMENDATION
The Fire Department recommends that the City Council authorize the Fire Chief to purchase a new bomb
dog from Global Academy of Somerset, Texas, in the amount of $9,800.
BACKGROUND
The Fire Department's bomb dog was retired in November 2012. Fire Engineer Anthony Mitchell has
been selected by the Fire Department to be the new dog handler.
The Fire Department solicited quotes from four vendors with the following results:
Global Training Academy of Somerset, Texas $9,800
World Wide Canine, Inc., of Spring Branch, Texas $10,500
K9 Inc. Does not train for explosives
Little Rock K9 Academy, of Littlerock Arkansas Does not train for explosives
The cost for a new bomb dog from Global Training Academy is $9,800; this amount includes four weeks
of training and lodging for the new dog and handler at Global Training Academy's facility. The Fire
Department has used Global Training Academy in the past and has received excellent service.
BUDGET/FISCAL EFFECT
Funds are available in Account Number 001 - 1121 - 522.92 -00 for the initial purchase and Account
Number 001 - 1121 - 522.56 -00 for the travel expenses (per diem).
STAFFING/EMPLOYEE EFFECT
None
SUMMARY
The Fire Department recommends that the City Council authorize the Fire Chief to purchase a new bomb
dog from Global Academy of Somerset, Texas in the amount of $9,800.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE FIRE CHIEF TO
PURCHASE A NEW BOMB DOG FROM GLOBAL TRAINING
ACADEMY OF SOMERSET, TEXAS, IN THE AMOUNT OF
$9,800; FUNDING AVAILABLE IN ACCOUNT NO. 001-
1121- 522.92 -00
WHEREAS, Tieske, the Port Arthur Fire Department Bomb Dog
was retired in November 2012; and
WHEREAS, the City Council of the City of Port Arthur finds
it to be in the best interest on the citizens of Port Arthur to
authorize the purchase of a new bomb dog; and
WHEREAS, money will be reallocated in account number 001-
1121- 522.92 -00 for the purchase of one bomb dog and the training
of one handler; and
WHEREAS, Global Training Academy of Somerset, Texas is the
vendor for the Fire Department's three previous bomb dogs; and
WHEREAS, the Fire Department solicited quotes from four
(4) vendors with Global Training Academy being the lowest and
best responsive quote(attached as Exhibit A); and
WHEREAS, the cost for a new bomb dog and handler training
from Global Training Academy of Somerset, Texas is $9,800.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. That the Fire Department is hereby authorized
to purchase a new bomb dog and canine handler training from
Global Training Academy for an amount not to exceed $9,800.
Section 3. That a copy of the caption of this resolution
shall be spread upon the Minutes of the City Council.

COMMENT
Our department has purchased and operated an explosive detection canine since 1999. . We have
since purchased two additional canines as replacement for various reasons. With the release of
Tieske upon Mark Sastre's retirement, we are in need of replacing the canine again. All .
previous purchases and training requirements have been supplied to our department though
Global Training Academy, Inc. out of Lytle, Texas which is near San Antonio, Texas.
In preparation for the purchase of the replacement canine, the following canine suppliers were
contacted for bids:
Global Training Academy, Inc. Cost including training: $ 9,800.00
World Wide Canine, Inc, Cost including training: $10,500.00
K9, Inc. Does not train for explosives No Bid
Little Rock K9 Academy Does not train for explosives No Bid
It is my recommendation that we purchase through Global. Training Academy, Inc. for the
following reasons:
1. The price quoted is lower than the other company who bid.
2. We have been using Global Training Academy since 1999 . and they provide professional
training with emphasis on handler safety techniques.
3. Global Training Academy has worked with us on schedule conflicts to accommodate our
training needs in the past.
4. Global Training Academy will provide canines trained to detect the following explosive
compounds and components: Safety Fuse (black powder), Smokeless Powder, SEMTEX,
Data Sheet, TNT (Military and Cast Charge), Nitro Dynamite, Ammonia Dynamite, C-4,
Comp B, Water Gell, Det Cord (PETN and H'MX).
Following purchase of the canine, Global Training Academy has a class for the handler which is
scheduled to begin on March 4, 2013, The initial training for the new handler with the canine is
normally 4 weeks in length. The successful completion of the course will provide a certificate
on the canine's training which can be supported should a criminal case go to court. The handler
will be required to return. to Global Training Academy annually for refresher and recertification.

The following quote (s9 is for a single purpose Explosive Detection Dog which includes the handler
lodging at our facility. The course is 4 weeks in length. This is our price to DOD and US Government
Agencies. I have attached a copy of our course Plan of Instruction.
The dog is trained on 11 Explosive Scents and comes with a 2 year medical guarantee against
any disabling medical ailment which existed at the time of sell and is verified by your Veterinarian. The dog is
guaranteed against Hip Dysphasia for 2 years after the sell.

detection abilities. Handlers will be able to maintain accurate training and use records for
development of proficiency and corrective training. Search techniques for explosives
concealed in buildings, vehicles, open area and luggage will be developed.

BSI PURCHASE, SALES & SERVICE AGREEMENT

THIS SALES AGREEMENT is made between WORLDWIDE CANINE, INC., whose
mailing address is 185 Mitchell Drive, Spring Branch Texas referred to as the "Seller ",
and , hereinafter referred to as "Buyer",
of the Dog described below which is being purchased to perform the duties of:

A. WARRANTIES:
(1) SELLER warrants that it has clear title to said dog(s). Seller will _ provide

a copy of all health records on the dog(s), specifically, X -ray elbows and
hips, blood scan, fecal, heartworm check, all current vaccinations and a
Vet health ce rtificate.

(2) SELLER warranties that it will provide handler/canine proficiency tea n g
at its facility. This training will include on and off leash obedience;
detection of smokeless powder, detonation cord (civilian and military),
data sheet, RDX, black powder, PETN, C-4, comp b, ammonium nitrate,
dynamite, TNT, Water Gel, and SEMTEX. No other warranties
expressed or implied, including the warranties of other purposes except
for in this Agreement. Length of training

will be three weeks.
(3) SELLER will replace the dog(s) if the dog(s) fail to perform to its
specified standards with the original certified handler for a period of one
year from the date of sale or if the dog(s) manifest a genetic defect one
year from the date of sale. Veterinary records, tests, and diagnosis
signed by a licensed veterinarian must be submitted before a dog will be
replaced for reasons of genetic condition. Any and all records on
retumed dogs must be retumed to Seller. Returned dogs will not be
replaced until/unless all records are retumed to Seller. Seller will NOT
replace dogs that have been spayed, neutered, resold, placed with a
different handler, or been abused, neglected, or injured.
(4) BUYER warrants that she/he has the expressed right to have an
independent veterinarian examine the dog(s) and is satisfied with those
findings and the general health of the dog(s), or accepts the findings of
the Seller's veterinary examination.

(5) BUYER warrants that it will maintain all training records, medical
treatment, and records of inoculations and engagement reports as well
as handler certification and proficiency.
B. CONSIDERATION:
The sales price for the dog is $10,000 (Sporting Breed) 10�00
Shepherd/Belgian Malinois) USD. SELLER agrees to sell BUYER the dog(s)
described herein and BUYER agrees to purchase said dog(s) on the terms set
forth herein. A deposit of fifty percent (50 %) is due with the execution of this
agreement and no later than 45 days prior to class date. The remaining monies
are due when the buyer arrives at the facility for training with the dog(s). This
cost will include handler's training, a leash and a choke chain. Worldwide
canine, Inc. will provide housing for handlers who are from out of town during
the "training" period, including kitchen and laundry facilities.
Transportation/Food costs for the handler are the responsibility of the client,
The length of the course will be 3 weeks.
C. REGISTRATION AND OWNERSHIP TRANSFERS:
Upon payment in full, SELLER agrees to provide all necessary papers and to
take all steps necessary to transfer ownership and registration of the animal to
BUYER if required.
D. The risk of loss passes from the Seller to the Buyer upon possession of the dog
by Buyer subject to the other terms set forth herein. The delivery of the dog(s)
will be 4-6 weeks following the execution of this agreement.
E. This BILL OF SALE represents the entire agreement between the parties. No
implied, agreements or promises, verbal or im p , are included unless
specifically included in this written agreement.
F. All expenses incurred after the signing of this BILL OF SALE including board
and further training of the dogs) shall be the responsibility of Buyer. Other than
stated herein.
G. LAW:
This BILL OF SALE is made and entered into in the State of Texas and shall be
enforced and interpreted under the laws of the State of Texas.
The terms of this Agreement and any disputes shall be resolved in accordance
with the laws of the State of Texas. Jurisdiction and venue shall be Coma!
County, Texas.
H. DEFAULT:
Upon any material breach of this Agreement by one party, the other party may
terminate the Agreement. Notice shall be given in writing and mailed to the
party alleged to be in breach of the Agreement at the address shown in this
Agreement. Notice shall be effective upon mailing the postage paid. All Notices
will be mailed registered or certified mail. Upon the finding by the Court that a
material breach occurred, the prevailing party shall have the right to recover
reasonable attorney's fees and court costs.
1. MISCELLANCEOUS CONDITIONS:
Time is of the essence with respect of this contract. BUYER accepts the dog
AS IS and WHERE IS at the Worldwide Canine, Inc. center.
J. HEADINGS:
Headings are not part of this contract but only for the convenience of the
parties.
K. SERVERABILITY:
Should a court of competent jurisdiction and venue determine that any of the
terms and or conditions of this agreement are unlawful or unenforceable such
determination shall not affect the validity or enforceability of any remaining
terms or conditions of this agreement.
This Agreement may be executed on duplicate originals.
The forgoing represents the entire Agreement between the parties. No modifications
or changes will be made except in writing and signed by the parties.
