Blackketter, P.E., Director of Public Works SUBJECT P.R. #17528 — APAC for the Concrete Repairs at Spur 93 and 62 Street DATE 25 January 2013 RECOMMENDATION: I recommend that the City Council approve Proposed Resolution No. 17528, approving a contract with APAC, Inc. of Beaumont, Texas for the Concrete Repairs at West Port Arthur Road (Spur 93) and 62 Street for the not to exceed amount of $12,500. BACKGROUND: The City of Port Arthur, Texas repaired a water line located in the intersection of 62 and West Port Arthur Road (Spur 93), which was temporarily patched with limestone. Because this is located in the state right of way, the repair is required to be in accordance with TxDOT standards. Accordingly, the City contacted four (4) contractors on 17 January 2013 who are pre - qualified to perform this type of work for TxDOT. We received three (3) quotes, with the one from APAC, Inc. determined to be the lowest and most responsible. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH APAC, INC. OF BEAUMONT, TEXAS FOR CONCRETE REPAIRS AT WEST PORT ARTHUR ROAD (SPUR 93) AND 62 STREET FOR $12,500. ACCOUNT 410 -1253- 532.36 -00 WHEREAS, the City of Port Arthur, Texas performed a waterline repair at the intersection of West Port Arthur Road (Spur 93) and 62 Street and is required to repair the roadway structure; and, WHEREAS, the City contacted four (4) vendors on 17 January 2013 and three (3) quotes were received on 25 January 2013 for the above mentioned concrete repairs; and, WHEREAS, the three (3) quotes received were evaluated by Public Works and Purchasing (see Exhibit "A "); now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Manager is hereby authorized to execute an agreement with APAC, Inc. of Beaumont, Texas (attached as Exhibit "B ") for the concrete repairs at West Port Arthur Road (Spur 93) and 62 Street intersection for the not to exceed amount of $12,500, funding being available in account 410 - 1253 - 532.36 -00; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. WITNESSED: That, for and in consideration of, the payment terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The CONTRACTOR will commence the work required by the Contract Documents upon Receipt of a Notice to Proceed. The work to be performed under this Contract will be completed within 1 day of commencement. 2. The CONTRACTOR will perform the work as delineated in the Scope of Work and Specifications attached hereto. 3. During the term of this Contract, the Contractor will furnish at this own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications and Scope of Work. 4. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein. The amount of this contract is $12,500. 5. The term "Contract Documents" means and includes the following" a. Agreement b. Specifications c. Quote d. Notice to Proceed 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 7. BY: Artie Tucker, Representative 1 cntroT ToicoutoeuR Department of Public Works Concrete Repair at SP 93 and 62 " Street January 11, 2012 This project will be a concrete repair — turn key job located at the intersection of SP 93 (West Port Arthur Road) and 62 " Street in Port Arthur, Texas. The contractor MUST visit the sites prior bidding the job. All existing dimensions of work area shalt be field verified by the contractor. The contractor shall perform the work in accordance with Item 361 in the Texas Department of Transportation Standard Specifications Manual, FDR(CP) -05 & JS -94 of the TxDOT Design Standards and Typical Application #20 and #27of the TMUTCD. All construction material shall come from an approved TxDOT supplier and shall provide documents as such. Contractor must notify the City and TxDOT personnel prior to concrete placement for inspection. The contractor shall remove all construction debris from the site completely and pay any required landfill tipping fees. Travel lane must re -open to traffic within eight (8) hours upon completion. Payment to contractor will be authorized when all construction repairs are completed in place and satisfy the City's and TxDOT's inspection for approval. Contractor must be TxDOT Certified.
