NO. 17553 To accept - Attaboy Termite and Pest Control, Inc. services and enter into a contract with them for monthly services at $1500 per year or 125 /month as per services rendered. DATE: March 22, 2013 RECOMMENDATION: The Transit Department recommends that the City Council authorize the City Manager to enter into a contract with Attaboy Termite and Pest Control, Inc. in an amount not to exceed $1500 /year. • BACKGROUND: Since Knock -out Pest Control contract expired, Transit desires contracted pest control services for its renovated maintenance building, terminal and propane station. BUDGET/FISCAL EFFECT: Funds are available in account no(s). 401- 1501 - 561.32 -00, 401 - 1503 - 561.32 -00, 401 -1505- 561.32 -00 and 401- 1506 - 561.32 -00, which payment will be split four ways. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A ONE YEAR CONTRACT WITH ATTABOY TERMITE AND PEST CONTROL, INC., OF BEAUMOUNT, TEXAS, IN AN AMOUNT NOT TO EXCEED $1,500; FUNDS AVAILABLE IN VARIOUS TRANSIT ACCOUNTS. WHEREAS, there is a need to obtain pest control services for the Transit Division facilities; and, WHEREAS, quotes were submitted by various vendors in the vicinity for the provision of these services; and, WHEREAS, specifications were transmitted regarding the sites to be treated and services to be provided; and, WHEREAS, three vendors submitted quotes as delineated in Exhibit "A "; and, WHEREAS, Attaboy Termite and Pest Control, Inc., of Beaumont, Texas, was the lowest and most responsive bid in an amount not to exceed amount of $1,500 per year. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct. THAT, the City Manager is authorized to enter into the contract attached hereto as Exhibit `B" with Attaboy Termite and Pest Control Inc. in an amount not to exceed $1,500 per year for pest control services for the Port Arthur Transit's facilities, which include the maintenance building, terminal and propane station. The term of this Contract shall be from April 10, 2013 to April 10, 2014 The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle with ten (10) days written notice. 2. The Contractor will supply all requirements as per State Law to render pest control as set forth by the U.S. Environmental Protection Agency for the City of Port Arthur Transit Department. 3. During, the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor. 4 The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein in the amount not to exceed $1,500.00 /year or $125 /month. 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 7.
