RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 17631, authorizing Change
Order #01 in extending the contract by 80 days bringing the total time to 210 days.
BACKGROUND:
The City Council previously executed a contract with N. & T. Construction Co., Inc. for the
Renovation of the Downtown Pavillion. The original time was one hundred thirty (130) days.
Change Order #01 will increase the contract time by eighty (80) days bringing the total contract
time to two hundred ten days (210) days with bid price amount remaining at $453,000.
BUDGETARY /FISCAL EFFECT:
Funding is available in 120 - 1429 - 582 -59.06 and 001 - 1003 - 512.59.00, Project M12005
EMPLOYEE /STAFF EFFECT:
None.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 17631, authorizing Change
Order #01 in extending the contract by 80 days bringing the total time to 210 days.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
CHANGE ORDER NO. 01 TO THE CONTRACT BETWEEN THE CITY
OF PORT ARTHUR AND N. & T. CONSTRUCTION CO., INC. FOR
THE RENOVATION TO THE DOWNTOWN PAVILION, INCREASING
THE CONTRACT TIME BY EIGHTY (80) DAYS TO A NEW TOTAL OF
TWO HUNDRED TEN (210) DAYS. ACCOUNT # 120- 1429 -582-
59.06 AND 001 - 1003 - 512.59.00, PROJECT M12005.
WHEREAS, on 15 October 2012, the City entered into a contract with N. & T.
Construction Co., Inc. for the Renovation for the Downtown Pavilion in the amount of
$453,000; and,
WHEREAS, the contract time commenced on November 12, 2012 and terminate
on May 27, 2013; and,
WHEREAS, N. & T. Construction Co., Inc. has requested a change order
increasing the original contract time by eighty (80) days to a new contract term of two
hundred ten (210) days due to lost days associated with changes made in ASI #2 which
includes additional structural steel, additional labor to erect the structural steel, and
additional supervision, attached hereto as Exhibit "A ", and,
WHEREAS, approval of Change Order No. 01 increasing the contract time to
two hundred ten (210) days is herein deemed an appropriate action; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, Change Order No. 01 is herein approved and the City Manager is
authorized to execute said Change Order; and,
