A RESOLUTION AMENDING RESOLUTION NO. 08 -178 AS IT PERTAINS TO REQUESTING A BILL TO BE ADOPTED BY THE TEXAS LEGISLATURE REGARDING THE APPOINTMENT PROCESS TO THE MUNICIPAL HOUSING AUTHORITY (REQUESTED BY MAYOR PRO TEM LEWIS) WHEREAS, Section 392 of the Texas Local Government Code provides for a Municipal Housing Authority; and WHEREAS, on April 22, 2008, the City Council approved Resolution No. 08 -178; and WHEREAS, it is deemed in the best interests of the citizens to amend Resolution No. 08 -178 to request Representative Allan B. Ritter, Representative Joe D. Deshotel, Senator Joan Huffman, and Texas Municipal League to file a bill to be adopted by the Texas Legislature to allow the governing body of a municipality located in a county with less than 600,000 residents to appoint commissioners to the Municipal Housing Authority. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinion in the preamble are true and correct. Section 2. That Resolution No. 08 -178 is hereby amended and Representative Allan B. Ritter, Representative Joe D. s.pr17662 Deshotel, Senator Joan Huffman, and Texas Municipal League are hereby requested to file a bill to be adopted by the Texas Legislature to allow the governing body of a municipality located in a county with less than 600,000 residents to appoint commissioners to the Municipal Housing Authority, in substantially the same form as attached hereto as Exhibit "A ". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Johnson, City Manager s.pr17662 EXHIBIT "A" A BILL TO BE ENTITLED An Act relating to the Appointment of Commissioners of a Municipal Housing Authority. BE IT ENACTED BY THE LEGISLATURE FO THE STATE OF TEXAS: Section 1. Section 392.031(a) is herein amended to read as follows: "(a) Each municipal housing authority shall be governed by five, seven, nine, or 11 commissioners. The governing body of a municipality located in a county with less than 600,000 residents, shall appoint five, seven, nine, or 11 persons to serve as commissioners of the authority. Each member of the governing body will have one (1) appointment. The appointee may only be removed by a majority of the governing body for a justifiable reason. In municipalities located in a county with more than 600,000 residents, the presiding officer of the governing body of a municipality shall appoint five, seven, nine, or 11 persons to serve as commissioners of the authority. An appointed commissioner of the authority may not be an officer or employee of the municipality. Appointments made under this section must comply with the requirements of Section 392.0331, if applicable ". s.pr17662 Section 2.
