RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 17649, approving an
interlocal agreement with Jefferson County for the Pleasure Island Shore Protection Breakwater -
Marsh Restoration Project and authorizing the expenditure of $619,690 for Additive Alternate 1.
BACKGROUND:
The City has been working with Jefferson County for some time to have a protection berm
constructed along the shoreline at various locations along Pleasure Island adjacent to the
Sabine — Neches Ship Channel. The County opened bids for the Pleasure Island Shore
Protection Breakwater -Marsh Restoration Project on March 19, 2013. The low bid for the base
project is $1,656,761. In addition, Additive Alternate 1 is an area of critical interest for the City,
This location is where the erosion has reached a point that the top of the slope is approximately
20 feet from T.B. Ellison Parkway. The value of this additive alternate is $619,690.
Jefferson County intends to award a contract for the Base Bid and Additive Alternate 1, for a
total contract amount of $2,276,451. This award is contingent upon the City committing to
providing the funding for the additive alternate. In Ordinance 13 -22, the Council approved a
budget amendment providing the needed additional funding. The interlocal agreement will
provide for the City paying the County for this project.

Funds are available in CIP201, 303 - 1601 - 591.59 -00

SUMMARY
I recommend that the City Council approve Proposed Resolution No. 17649, approving an

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF PORT
ARTHUR AND JEFFERSON COUNTY FOR SHORELINE PROTECTION
OF PLEASURE ISLAND AND AUTHORIZING THE EXPENDITURE OF
$619,690 FOR THIS PROJECT. CIP201, 303 - 1601- 591.59 -00.
WHEREAS, Jefferson County has procured the design, obtained the necessary
permit(s) and bid the construction of the Pleasure Island Shore Protection Breakwater -
Marsh Restoration Project; and,
WHEREAS, the purpose of this project is to protect the existing shoreline of
Pleasure Island along the Sabine - Neches Ship Channel, and this project meets all the
requirements of Section 791.011 of the Texas Government Code; and,
WHEREAS, Jefferson County intends to award the Base Bid for the Pleasure
Island Shore Protection Breakwater -Marsh Restoration Project in the amount of
$1,656,761; and,
WHEREAS, the City of Port Arthur desires that Additive Alternate 1 of the
Pleasure Island Shore Protection Breakwater -Marsh Restoration Project in the amount
of $619,690 be constructed along with the Base Bid; and,
WHEREAS, in Ordinance 13 -22, the City Council amended the general fund
budget for Fiscal Year 2012 -2013 to provide the necessary funding for Additive
Alternate 1; and,
WHEREAS, the City Council deems it in the public interest to expend $619,690
for the construction of Additive Alternate 1 as part of this award; now, therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the City Manager of the City of Port Arthur is hereby authorized and
directed to execute on behalf of the City, an Interlocal Agreement between the City
ofPort Arthur and Jefferson County for the Shore Protection Breakwater -Marsh
Restoration Project as shown on Exhibit "A" attached hereto and made a part hereof;
and,
THAT, payment to Jefferson County in the amount of $619,690 in accordance
with the attached interlocal agreement is hereby authorized, funding being available in
CIP201, 303 - 1601 - 591.59 -00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

EXHIBIT A
INTERLOCAL AGREEMENT
BETWEEN THE CITY OF PORT ARTHUR AND JEFFERSON COUNTY
FOR THE
PLEASURE ISLAND SHORE PROTECTION BREAKWATER -MARSH
RESTORATION PROJECT
The City of Port Arthur, acting by and through its City Manager, and Jefferson County, acting by
and through its County Judge, agree to the following terms and conditions for funding the
Pleasure Island Shore Protection Breakwater -Marsh Restoration Project:
WHEREAS, Jefferson County has procured the design, obtained the necessary permit(s)
and bid the construction of the Pleasure Island Shore Protection Breakwater -Marsh Restoration
Project; and,
WHEREAS, Jefferson County intends to award the Base Bid for the Pleasure Island
Shore Protection Breakwater -Marsh Restoration Project in the amount of $1,656,761; and,
WHEREAS, the City of Port Arthur desires that Additive Alternate 1 of the Pleasure
Island Shore Protection Breakwater -Marsh Restoration Project in the amount of $619,690 be
constructed along with the Base Bid; and,
WHEREAS, the City Council deems it in the public interest to expend $619,690 for the
construction of Additive Alternate 1 as part of this award; now, therefore,
BE IT AGREED BY AND BETWEEN THE PARTIES:
SECTION ONE: That, the City of Port Arthur herein agrees to pay Jefferson
County $619,690 for Additive Alternate 1 of the Pleasure Island Shore Protection Breakwater -
Marsh Restoration Project.
SECTION TWO: That, the Jefferson County herein agrees to award the Base Bid
in the amount of $1,656,761 and Additive Alternate 1 in the amount of $619,690 for the Pleasure

Island Shore Protection Breakwater -Marsh Restoration Project, for a total contract award of
$2,276,451.
SECTION THREE: That, pursuant to Section 791.011 of the Government Code,
V.T.C.A., the City of Port Arthur will make payment to Jefferson County for Additive Alternate
1 of the Pleasure Island Shore Protection Breakwater -Marsh Restoration Project from current
revenue available to the City. Said payment to be payable to "Jefferson County ", referencing
project "IFB 13- 003\KJS, Pleasure Island Revised Breakwater Project Additive Alternate 1" and
to be made within 15 calendar days of the execution of this agreement by both parties.
