A RESOLUTION AUTHORIZING A CONTRACT WITH LOU RICHARD'S REALTY FOR THE PREPARATION OF A MARKET ANALYSIS FOR THE PURPOSE OF ASSISTING IN UPDATING THE CITY'S COMPREHENSIVE PLAN IN AN AMOUNT NOT TO EXCEED $5,000, FUNDING AVAILABLE IN ACCOUNT NUMBER NO. 001 -1003- 512.59 -00, PROJECT NO. M07004. WHEREAS, the City is interested in making a determination of the availability of property to update its comprehensive plan and for future housing development; and WHEREAS, it is necessary to obtain the services of a licensed real estate agent and broker to compile data regarding the status of property in and throughout the corporate limits of Port Arthur, Texas; and WHEREAS, Lou Richard is a licensed real estate agent and broker and has over thirty years of experience in this area and has worked extensively with properties in all areas of the City; and WHEREAS, the Contractor will work with the Planning Department to identify how available properties can be utilized for future land changes such as residential housing, park areas, and commercial /retail development, which will be useful for revising and updating the City's Comprehensive Plan. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: s.pr17663 1 APPROVED AS TO FORM: 2 /ie �27 z (D City Attorney APPROVED FOR ADMINISTRATION: City Manager APPROVED AS TO AVAILABILITY OF FINDS: &0L Director of Finance s.pr17663 Exhibit "A" AN AGREEMENT BETWEEN THE CITY OF PORT ARTHUR AND LOU RICHARD'S REALTY THIS AGREEMENT, made this day of , 2013, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Lou Richard's Realty herein acting by and through Mrs. Lou Richards, hereinafter called "CONTRACTOR ". WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The Contractor will prepare a market analysis of properties located with the corporate limits of Port Arthur. Said market analysis of properties will be presented to the City Council in the form of written report. 2. The analysis will include summary of vacant properties that meet the City's Building and Zoning Ordinance requirements. 3. The Contractor will work with the Planning Department, in an effort to update the City's Comprehensive Plan, to help identify the areas of potential growth. 4. The report will also identify areas that can be used for potential park and quality of life improvements and possible commercial and retail uses. 5. The Contractor agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the total price not to exceed $5,000. 6. The Contractor agrees to perform all the work described herein and will commence the work required as specified in the "Notice to Proceed ". The CONTRACTOR will complete the work within 30 working days unless the period for completion is extended otherwise by the contract Documents. 7. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in (2 copies) each of which shall be deemed an original on the date first above written.
