ASS . - . - ' - • ' -- ' INTEROFFICE MEMORANDUM TO: PLANNING & ZONING COMMISSION FROM: PAUL BROWN, SENIOR PLANNER SUBJECT: SITE PLAN FOR A 160 -FOOT VERISON MONO -POLE CELL TOWER DATE: 06/12/2013 BACKGROUND Proteus Services LLC has applied for construction of a 160 -foot tall, mono -pole cell tower for Verizon in the Park Plaza subdivision at 3746 Park Lane. This property is owned by Johnny Orta, who has leased it for the cell tower location. This property is located in a Light Commercial (LC) zoned district and the tower land use is allowed by right in an LC district. As such, no Specific Use Permit or other zoning change is necessary for construction of the tower since the structure satisfies all the distance requirements set forth in the City's Zoning Ordinance. In the Zoning Ordinance Special Conditions, a cell tower must "shall be [no] closer to any residential district boundary line than a distance equal to the sum of the required yard setback specified for the zoning district in which such structure is located, plus 25 feet, plus twice the height of the portion of the structure above two stories (23 feet). Such distance shall be measured as the shortest possible distance in a straight line from the structure to the closest point of a residential district boundary line." The setback distance is specified to be a residential front yard setback, which is 20 feet. As such, the formula is as follows: 20 +25 +2(160 -23) =319 ft. In approximate distances based on Google Earth, the tower is no closer to a residentially zoned district (A, SF, 2F, MH, MF) than 770 feet to the northeast, 610 feet to the southeast, 895 feet to the southwest, and 735 feet to the northwest. As such, the proposed structure is more than twice the required distance from the nearest residentially zoned district 1 in three directions and just slightly less than twice the distance in the fourth direction.
