Freeman, Acting Director of Housing and Neighborhood Revitalization Date: July 2, 2013 Re: P.R. 17756 RECOMMENDATION: It is recommended that City Council adopt P.R. No. 17756 rescinding Resolution No. 13 -259 in its entirety. BACKGROUND: The Housing Division identified and certified the homebuyer as eligible to receive up to $30,000 to assist with the purchase of a new construction home located at 2334 5 Street, Port Arthur, Texas. The funds were to be used to assist with down payment assistance and closing fees associated with the purchase of the home. Resolution No. 13 -259 authorized the execution of a homebuyer's written agreement to receive up to $30,000 for the purchase of a newly constructed home located at 2334 5 Street, Port Arthur, Texas, through the City's Homebuyers Assistance Program. The Texas Department of Housing and Community Affairs determined that since the homebuyer received the up to $30,000 down payment assistance from the Neighborhood and Stabilization Program they did not need the additional down payment assistance of up to $30,000 from the City's Homebuyers Assistance Program. BUDGETARY /FISCAL EFFECT: N/A STAFFING /EMPLOYEE EFFECT: Housing Department staff will be responsible for program administration. SUMMARY: It is recommended that City Council adopt P.R. No. 17756 rescinding Resolution No. 13 -259 in its entirety. PR 17756 P. R. 17756 07/01/13 BAF /DF RESOLUTION NUMBER A RESOLUTION RESCINDING RESOLUTION NO. 13 -259 IN ITS ENTIRETY, WHICH AUTHORIZED THE EXECUTION OF A HOMEBUYER'S WRITTEN AGREEMENT FOR THE PURCHASE OF 2334 5 STREET, PORT ARTHUR, TEXAS THROUGH THE CITY'S HOMEBUYER'S ASSISTANCE PROGRAM. WHEREAS, the City Council, by its adoption of Resolution Number 12 -160, authorizing submission of the 2012 Action Plan, has obligated itself to provide assistance to low and moderate income persons /families; and WHEREAS, a homebuyer was identified and certified to receive up to $30,000 down payment assistance and closing fees associated with the purchase of a home located at 2334 5th Street, Port Arthur, Texas, from the City's Homebuyer's Assistance Program; and WHEREAS, the Texas Department of Housing and Community Affairs determined that since the homebuyer, Sabina Johnson, received up to $30,000 from the Neighborhood and Stabilization Program Grant, she did not need to receive the additional down payment assistance from the City's Homebuyer's Assistance Program; and WHEREAS, the City Council deems it appropriate to rescind Resolution No. 13 -259 in its entirety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. THAT, the facts and opinions in the preamble are true and correct. Section 2. THAT, Resolution No. 13 -259 is hereby rescinded in its entirety. Section 3. THAT, a copy of the caption of this Resolution be spread upon the minutes of the City Council.
