BACKGROUND:
The Planning and Zoning Commission is being asked to consider a zoning district change
from Single Family (SF) to Light Commercial (LC) for a 6.531 acre tract of land out of and a
part of Lot 5, Block 3, Range "F ", Port Arthur Land Company Subdivision, City of Port
Arthur. The abutting zoning designations are: Light Commercial (LC) to the north, south and
west and Single Family (SF) to the east.
On Wednesday, July 24, 2013, twenty -seven (27) notices were mailed to adjacent property
owners within a 200 ft. radius and the notice was published in the Port Arthur News on
Sunday, July 21, 2013, more than ten (10) days prior to the P &Z public hearing scheduled
for August 5, 2013.

SHOP IN TWO- FAMILY ZONED DISTRICT, 3632 THOMAS BOULEVARD, 0.1607
ACRE OF LAND CONSISTING OF LOT 4, BLOCK 588, MODEL ADDITION, CITY OF
PORT ARTHUR, JEFFERSON COUNTY, TEXAS (PROPERTY LOCATED SOUTH OF
THOMAS BOULEVARD AND WEST OF 9TH AVENUE).

BACKGROUND:
The Planning and Zoning Commission is being asked to consider a Specific -Use Permit
(SUP# 219) for 0.1607 acre of land consisting of Lot 4, Block 588, Model Addition, City of
Port Arthur that will allow a Barber Shop in a Two Family zoned district. The abutting
zoning designations are: Two Family (2F) to the north, south, east and west.
On Monday, July 15, 2013 the Planning & Zoning Commission held a public hearing to
discuss the above mentioned case. Nineteen (19) property owners were notified of the
proposed request. The following is a summary of responses received:
Speaking (P &Z HEARING - 07/15/2013):
Favor 2 (property owner within 200 feet of site; including applicant)
Opposition 0 (property owners within 200 feet of site)
Written (P &Z HEARING - 07/15/2013):
Favor 0 (property owner within 200 feet of site)

The Planning & Zoning Commission voted unanimously to table this case requesting that
off - street parking be included on the site plan being submitted.
According to the Zoning Ordinance, a beauty /barber shop allowed in a residentially -zoned
district by specific use permit must provide at least 2 off - street parking spaces located
behind the required 20 -foot front yard setback area. The Zoning Ordinance elsewhere
requires at least one off - street parking space for each 300 square feet of building space.
The proposed shop will have 700 square feet, so 3 off - street parking spaces have been
provided in the back yard of the residence, with the parking area being accessed by the
alley way running along the longer dimension of the residential lot. This alley is somewhat
improved with a gravel surface that will allow clear access during inclement weather.
Since an alley is public right -of -way that should be accessible at any time by the general
public. It is the adjacent property owners' responsibility to maintain the alley way to
ensure that it remains passible.

RECOMMENDATION: The Planning staff has no objections to the approval of this request
for Specific -Use Permit - 219 with the following stipulation:
• Minimum of 3 parking spaces.
BUDGETARY /FISCAL EFFECT: None
STAFFING /EMPLOYEE EFFECT: None
SUMMARY: The request conforms to all zoning requirements, hence acceptance of this case
is recommended.
