Gougle earth feet 500 meters 100 INTEROFFICE MEMORANDUM TO: THE CITY OF PORT ARTHUR - PLANNING AND ZONING COMMISSION FROM: PAUL BROWN, SENIOR PLANNER SUBJECT: PROPOSED DEADLINE FOR SUBMISSION OF OPPOSITION TO ZONING CHANGES DATE: 06/21/2013 PROPOSED CHANGE: The Planning Staff recommends that a submission deadline be added to Port Arthur City Code Appendix A, Section 24 -105, which establishes rules for determining if written opposition equals or exceeds 20% of the area closer than 200 feet from the property for which rezoning has been requested. We suggest that individuals owning property within the 200 -foot area submit to the City Secretary's Office their opposition or approval in writing before the close of business on the day following the public hearing before City Council. The opinions must be presented in writing to meet the standards set by State law. Initially, Mr. Burton and I discussed having the deadline fall at close of business on the same day as morning meetings and on the day following night meetings. However, P &Z Chairman Fernando Ramirez suggested simplifying the rule to uniformly require written opinions to be submitted at close of business on the day after the public hearing before Council regardless if it falls on a morning or evening meeting. We agree with the suggestion for the sake of its simplicity of enforcement and explanation. Such a deadline will provide a uniform rule that does not require special or convoluted explanation based on the Council's meeting schedule. If P &Z Commissioners agree to recommend approval of this amendment to City Council, we can expect the Council to hold its public hearing on the issue on either October 1 or 15. The Council vote on the matter could then be scheduled at the meeting following the public hearing. Also, since this involves the City Council's public hearing and subsequent rezoning vote, the opinions must go to the City Secretary. RECOMMENDATION: The Planning staff recommends approval of this amendment to City Council. PART II - CODE OF ORDINANCES APPENDIX A - ZONING SECTION 24. - AMENDMENTS SECTION 24. - AMENDMENTS 24 -100. - Initiation of changes. 24 - 100. - Initiation of changes. Any person or corporation having a proprietary interest in any property may petition the city council for a change or amendment to the provisions of this ordinance. The planning and zoning commission may on its own motion or on request from the city council institute study and proposal for changes and amendments in the public interest. 24 -101. Types of changes permitted. The city council may, from time to time, amend, supplement or change by ordinance, the boundaries of the districts or the regulations herein established as provided by the statues of the State of Texas. 24 -102. Changes to be considered by planning and zoning commission first, then by council. Before taking action on any proposed amendment, supplement or change, the council shall submit the same to the planning and zoning commission for its recommendation and report. The commission may recommend that the amendment be approved as requested, or it may recommend a more restrictive amendment than that requested in accordance with section 7, or it may recommend that the amendment be denied. 24 -103. Notification requirements. The planning and zoning commission shall hold a public hearing on any application for any amendment or change prior to making its recommendation and report to the city council. When any such amendment or change relates to a change in classification or boundary of a zoning district, written notice of public hearing before the planning and zoning commission on the proposed amendment or change shall be mailed to all owners of real property lying within 200 feet of the property on which the change is requested. Such notice shall be given not less then ten days before the date set for hearing by depositing in the mail such notice, properly addressed and postage paid, to each taxpayer as the ownership appears on the last approved city tax roll. When any such amendment relates to a change of a zoning regulation or to the text of this ordinance not affecting specific property, notice of the public hearing of the planning and zoning commission shall be given by publication in a newspaper of general circulation in the City of Port Arthur without the necessity of notifying property owners by mail. Such notice shall state the time and place of such hearing and the nature of the subject to be considered, which time shall not be earlier then ten days from the date of publication. 24 -104. Public hearing requirements. A public hearing shall be held by the city council before adopting any proposed amendment, supplement or change. Notice of such hearing shall be given by publication in a newspaper of general circulation in the City of Port Arthur stating the time and place of such hearing, which time shall not be earlier than 15 days from the date of publication. The city council hearing may be conducted as a joint hearing with the planning and zoning commission in accordance with the provisions of V.T.C.A., Local Government Code § 211.007. 24 -105. Three - fourths council vote required under some circumstances. Unless a proposed amendment, supplement or change has been approved by the planning and zoning commission, or if a protest against such proposed amendment, supplement or change has been filed with the city secretary, duly signed and acknowledged by the owners of 20 percent or more, either of the area of the lots or land included in such proposed changes, or of the lots or land immediately Port Arthur, Texas, Code of Ordinances Page 1 PART II - CODE OF ORDINANCES APPENDIX A - ZONING SECTION 24. - AMENDMENTS adjoining the same and extending 200 feet therefrom, such amendment shall not become effective except by the favorable vote of three - fourths of all the members of the city council. 24 -106. Possible administrative fees. The city council may, by separate ordinance or ordinances, provide for fees to be paid by a petitioner to cover the administrative and advertising costs related to petitions for amendment or change to this ordinance. 24 -107. Limitations on reapplications. When the city council has denied a proposal, or when an application has been withdrawn at or before the commission meeting thereon and after giving of public notice, no new applications of like nature shall be accepted by the city or scheduled for hearing by the commission within a period of 12 months of the date of council denial or withdrawal of application; provided, however, on receipt of written request by the original applicant stating how conditions have changed substantially in the community since consideration of the prior proposal so as to justify an earlier review of this matter, the planning and zoning commission may waive the mandatory delay period and authorize acceptance of a new application.
