NO. 17849 — RESCINDING A CONTRACT TO SCRAPS & METALS DEMO FOR THE DEMOLITION OF SIX (6) DANGEROUS RESIDENTIAL STRUCTURES (GROUP D) LOCATED THROUGHOUT THE CITY, AND AUTHORIZING THE REBIDDING OF THE WORK COMMENT RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 17849 rescinding a contract award to Scraps & Metals Demo in the amount of $17,775.00 for the demolition and removal of six (6) dangerous residential structures located throughout the City, and authorizing the rebidding of the project. BACKGROUND: Bids for demolition of forty -seven (47) residential structures were opened on December 19, 2012. Scraps & Metals Demo was the low bidder for Group D at $17,775.00, to be completed within thirteen (13) working days from the date they receive a Notice to Proceed. A contract was awarded to Scraps & Metals Demo by Resolution Number 13 -047 on January 22, 2013. A Notice to Proceed was never issued because Mr. Bradley never attempted to begin this contract; he failed to complete two (2) properties on another contract or to complete maintenance items at two properties on yet another contract. Mr. Derrick Bradley of Scraps & Metals Demo has failed to complete the contract in the manner agreed upon. He has failed to provide adequate equipment and staff to complete the work. Mr. Bradley has failed to communicate with Demolition staff for over seven (7) days. We then advised him on August 7, 2013 that we would terminate his contracts. Mr. Bradley has failed to complete work on two other contracts after several failed promises to do so. The contractor has violated his contract by failing: (1) to begin or execute the work properly as agreed to, (2) to do any work for a period of over five (5) consecutive days, (3) to respond to written or oral communication; and (4) to fulfill his contract in the prescribed period of time without proper notification to the City regarding delays. Scraps & Metals Demo has not demonstrated the ability or willingness to complete a contract in the proper manner or to provide the equipment and or staff needed to complete the work. Please see the attached email for supporting documentation. Scraps & Metals Demo has been notified that its contract for this group will be terminated and that this matter is being presented to the City Council. Funding is available in Account No. 105 - 1431 - 552.59 -00; Project No. C36120 (CDBG). STAFF LEVEL IMPACT: Acceptance of this recommendation will have no effect on current staffing level. SUMMARY: Staff recommends that the City Council adopt P. R. We have notified Mr. Bradley to cease any and all activity on these contracts. He has stated he's been in the hospital on three (3) separate occasions, and he has failed to respond to calls and letters. I have requested several times that Mr. Bradley submit an invoice for the work he completed on Group C (3/6/13 contract), but he has not responded. FYI: he has signed an agreement to forfeit all monies to pay his landfill bill until it is paid in full. . C36120. WHEREAS, the City Council of the City of Port Arthur awarded a contract to Scraps & Metals Demo, which was approved by Resolution Number 13 -047 on January 22, 2013 (for the demolition of six (6) dangerous residential structures — Group D) in the amount of $17,755; and WHEREAS, Scraps & Metals Demo has violated a separate contract by failing: (1) to begin or execute the work properly as agreed to, (2) to do any work for a period of over five (5) consecutive days, (3) to respond to written or oral communication; and (4) to fulfill his contract in the prescribed period of time without proper notification to the City regarding delays; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT it is in the best interest of the City of Port Arthur to rescind said contract award with Scraps & Metals Demo; and THAT the City Council of the City of Port Arthur hereby rescinds Resolution Number 13 -047, which awarded a contract to Scraps & Metals Demo, for the demolition of six (6) dangerous residential properties; and THAT the City Council hereby authorizes the rebidding of the demolition of six (6) dangerous residential structures in Group D. THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
