DEMO FOR THE DEMOLITION OF SIX (6) DANGEROUS RESIDENTIAL
STRUCTURES (GROUP C) LOCATED THROUGHOUT THE CITY, AND
AUTHORIZING THE REBIDDING OF THE WORK
COMMENT
RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 17847
terminating a contract award with Scraps & Metals Demo in the amount of *$12,379.00 for the
demolition and removal of six (6) dangerous residential structures located throughout the City, and
authorizing the rebidding of the project.
BACKGROUND: Bids for demolition of twenty -five (25) residential structures were opened on
February 27, 2013. Scraps & Metals Demo was the low bidder for Group C at *$16,915.00, to be
completed within ten (10) working days from the date they receive a Notice to Proceed. A contract
was awarded to Scraps & Metals Demo by Resolution Number 13 -108 on March 6, 2013. A Notice
to Proceed was issued on June 19, 2013; the work was to have been completed on July 2, 2013.
When we contacted Mr. Derrick Bradley of Scraps & Metals Demo by telephone he advised us that
he was in the hospital (for the third time), but he would have someone to complete the work. Mr.
Bradley failed to complete the demolition of a garage at 3228 32n Street (it is 75% complete); and he
failed to begin the demolition of the garage located at 4817 Dryden Road. The fill material is
partially spread at 3027 10` Street and his trackhoe has remained there for over a month. Mr.
Bradley has also failed to complete maintenance items on another contract, and he has failed to
begin demolition of a third and final group. He agreed that he would complete demolition/
maintenance of the three aforementioned properties, but failed to do so. We then advised him on
August 7, 2013 that we would terminate his contract and that he should not do any further work on
any contract.
The contractor has violated his contract by failing: (1) to begin or execute the work properly as
agreed to, (2) to do any work for a period of over five (5) consecutive days, (3) to respond to written
or oral communication; and (4) to fulfill his contract in the prescribed period of time without proper
notification to the City regarding delays. Scraps & Metals Demo has not demonstrated the ability or
willingness to complete a contract in the proper manner or to provide the equipment needed to
complete the work. Please see the attached email for supporting documentation. Scraps & Metals
Demo has been notified that its contract for this group will be terminated and that this matter is
being presented to the City Council. (CONTINUED)

BUDGET AND REVENUE IMPACT: Acceptance of this recommendation will not require a
budget amendment. Funding is available in Account No. 303 - 1603 - 591.59 -00; Project No. CIP614
(EDC).
STAFF LEVEL IMPACT: Acceptance of this recommendation will have no effect on current
staffing level.
SUMMARY: Staff recommends that the City Council adopt P. R. No. 17847, terminating a
contract with Scraps & Metals Demo in the amount of *$12,379.00 for the demolition and
removal of six (6) dangerous residential structures located throughout the City, and authorizing the
rebidding of the project.

Scraps & Metals has incomplete maintenance items at two locations in one contract, has failed to complete two (2)
structures in a second contract, and cannot begin work on the third contract. We have notified Mr. Bradley to cease
any and all activity on these contracts. He has stated he's been in the hospital on three (3) separate occasions, and
he has failed to respond to calls and letters. I have requested several tunes that Mr. Bradley submit an invoice for
the work he completed on Group C (3/6/13 contract), but he has not responded. FYI: he has signed an agreement
to forfeit all monies to pay his landfill bill until it is paid in full.

A RESOLUTION TERMINATING A CONTRACT WITH
SCRAPS & METALS DEMO IN THE AMOUNT OF
$16,915, AND AUTHORIZING THE REBIDDING OF
THE DEMOLITION OF ONE (1) STRUCTURE,
REMOVAL OF DEMOLITION DEBRIS FROM ONE (1)
STRUCTURE, AND THE MAINTENANCE ON ONE (1)
PROPERTY (GROUP C), TO BE CHARGED TO
ACCOUNT NO. 105 - 1431 - 552.59 -00, PROJECT NO.
C36120.
WHEREAS, the City Council of the City of Port Arthur awarded a contract to Scraps & Metals Demo,
which was approved by Resolution Number 13 -108 on March 6, 2013 (for the demolition of six (6) dangerous
structures — Group C (one structure was removed from the contract because it was demolished and rebuilt with
disaster funds by SETRPC); and
WHEREAS, the contractor has violated his contract by failing: (1) to execute the work properly as agreed
to, (2) to do any work for a period of over five (5) consecutive days, and (3) to fulfill his contract in the prescribed
period of time without proper notification to the City regarding delays;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT it is in the best interest of the City of Port Arthur to terminate said contract with Scraps & Metals
Demo; and
THAT the City Council of the City of Port Arthur hereby terminates its contract with Scraps & Metals
Demo, as delineated above; and
THAT the City Council hereby authorizes the rebidding of the demolition of one (1) structure, the removal
of demolition debris and dirt work at one (1) property, and for the maintenance on one (1) property in Group C.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
