Smith, RN, BSN, Director of Health DATE: September 4, 2013 SUBJECT: Proposed Resolution No. 17876 Contract Renewal between the City of Port Arthur and Lloyd Haggard, M.T. RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 17876, a renewal contract for Professional Services between the City of Port Arthur and Mr. Lloyd Haggard, M.T. BACKGROUND: Mr. Lloyd R. Haggard, Microbiologist, has provided consultation services to the City of Port Arthur since 2002. Mr. Haggard currently receives a monthly rate of $1,180 due to Social Security benefit limitations and $80 per month for cell phone consultation. There will be no change in compensation for the next fiscal year. STAFFING/EMPLOYEE EFFECT: None. BUDGETARY EFFECT: Funds are available in general account numbers 001 - 1301 - 541.54 -00 and 001- 1301 - 541.13 -00. A RESOLUTION AUTHORIZING A RENEWAL TO THE AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES BETWEEN THE CITY OF PORT ARTHUR AND LLOYD R HAGGARD FOR CONSULTATION SERVICES FOR THE CITY'S LABORATORY, ACCOUNT NUMBERS 001 - 1301 - 541.54 -00 AND 001 - 1301 - 541.13 -00 WHEREAS, the City Health Department needs a Microbiologist to act as consultant for the laboratory; and, WHEREAS, Mr. Lloyd R. Haggard, Microbiologist, has provided consultation services to the City of Port Arthur since 2002; and, WHEREAS, due to Social Security benefit limitations, Mr. Haggard currently receives $1,180 per month for professional consultation services for the City's laboratory and a cell phone allowance in the amount of $80 per month for telephone consultation; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR: Section 1. That the facts and preamble are true and correct. Section 2. That the City Manager and Director of Health are hereby authorized to execute said renewal, a copy of which is attached hereto as Exhibit "A ". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. P.R. Smith, RN, BSN Director of Health Services APPROVED FOR THE AVAILABILITY OF FUNDS: :i LL * 1_LL A � eborah Echols, CPA, Director of Finance EXHIBIT "A" AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES That this Agreement is made between the City of Port Arthur, Texas hereinafter referred to as "City" and Lloyd R. Haggard, M.T., a person certified to perform as a Medical Technologist. I. TERM OF AGREEMENT That this Agreement shall be for a period beginning September 1, 2013 and shall remain in force through September 30, 2014. II. COMPENSATION That Lloyd R. Haggard, M.T., shall be paid Eleven Hundred and Eighty Dollars ($1,180.00) per month for laboratory consultant services rendered. Mr. Haggard will also receive a cell phone allowance in the amount of $80 per month for telephone consulting services. The hours of work shall be mutually agreed upon by the Director of Health of the City of Port Arthur and Lloyd R. Haggard and shall be reduced to approximately nine (9) hours per week unless approved by the Director of Health. Mr. Haggard will be considered an independent contractor for the City, and shall provide consultant services in compliance with guidelines of the Clinical Laboratory Improvement Act (CLIA). Such services shall be at the standard of care and expertise expected of Medical Technologists in the State of Texas. III. BENEFITS That all benefits resultant from this contract are delineated herein, and no other benefits promised by any City officer shall be binding on the City. The Director of Health Services may, depending on the benefit to the City and availability of funds, approve funds for training and /or conference attendance. IY. TERMINATION That this Agreement can be terminated with thirty (30) days written notice by either party. SIGNED AND AGREED TO on the day of , 2013. CONTRACTOR Lloyd R. Haggard, M.T.
