NO. 17848 — TERMINATING A CONTRACT WITH SCRAPS & METALS DEMO FOR THE DEMOLITION OF SIX (6) DANGEROUS RESIDENTIAL STRUCTURES (GROUP C) LOCATED THROUGHOUT THE CITY, AND AUTHORIZING THE REBIDDING OF THE WORK COMMENT RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 17848 terminating a contract award with Scraps & Metals Demo in the amount of $14,971.20 for the demolition and removal of six (6) dangerous residential structures located throughout the City, and authorizing the rebidding of the project. BACKGROUND: Bids for demolition of forty -seven (47) residential structures were opened on December 19, 2012. Scraps & Metals Demo was the low bidder for Group C at $14.971.20, to be completed within twelve (12) working days from the date they receive a Notice to Proceed. A contract was awarded to Scraps & Metals Demo by Resolution Number 13 -046 on January 22, 2013. Scraps & Metals has failed to complete maintenance items at two properties in this contract, failed to complete two (2) properties on another contract or to begin work on a third contract. Mr. Derrick Bradley of Scraps & Metals Demo has failed to complete the contract in the manner agreed upon. He was instructed and agreed to repair the damaged sidewalk and to bring more dirt in at 1201 E. 14 Street. Mr. Bradley has failed to do any further work after agreeing to complete the debris removal and leveling on the aforesaid two remaining lots. We then advised him on August 7, 2013 that we would terminate his contract and agreed that he should not do any further work on any contract. The contractor has violated his contract by failing: (1) to begin or execute the work properly as agreed to, (2) to do any work for a period of over five (5) consecutive days, (3) to respond to written or oral communication; and (4) to fulfill his contract in the prescribed period of time without proper notification to the City regarding delays. Scraps & Metals Demo has not demonstrated the ability or willingness to complete a contract in the proper manner or to provide the equipment and or staff needed to complete the work. Please see the attached email for supporting documentation. Scraps & Metals Demo has been notified that its contract for this group will be terminated and that this matter is being presented to the City Council. Funding is available in Account No. 105 - 1431 - 552.59 -00; Project No. C36120 (CDBG). STAFF LEVEL IMPACT: Acceptance of this recommendation will have no effect on current staffing level. SUMMARY: Staff recommends that the City Council adopt P. R. R. 17849) Attachments: Darlene Thomas - Pierre.vcf Scraps & Metals has incomplete maintenance items at two locations in one contract, has failed to complete two (2) structures in a second contract, and cannot begin work on the third contract. We have notified Mr. Bradley to cease any and all activity on these contracts. He has stated he's been in the hospital on three (3) separate occasions, and he has failed to respond to calls and letters. I have requested several times that Mr. Bradley submit an invoice for the work he completed on Group C (3/6/13 contract), but he has not responded. A RESOLUTION TERMINATING A CONTRACT WITH SCRAPS & METALS DEMO IN THE AMOUNT OF $14,971.20, AND AUTHORIZING THE REBIDDING OF THE MAINTENANCE ON TWO (2) PROPERTIES (GROUP C), TO BE CHARGED TO ACCOUNT NO. 105- 1431-552.59-00 PROJECT NO. C36120 WHEREAS, the City Council of the City of Port Arthur awarded a contract to Scraps & Metals Demo, which was approved by Resolution Number 13 -046 on January 22, 2013 (for the demolition of six (6) dangerous structures — Group C); and WHEREAS, the contractor has violated his contract by failing: (1) to execute the work properly as agreed to, (2) to do any work for a period of over five (5) consecutive days, and (3) to fulfill his contract in the prescribed period of time without proper notification to the City regarding delays; and the contractor has illegally dumped demolition debris, thereby creating code violations; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT it is in the best interest of the City of Port Arthur to terminate said contract with Scraps & Metals Demo; and THAT the City Council of the City of Port Arthur hereby terminates its contract with Scraps & Metals Demo, as delineated above; and THAT the City Council hereby authorizes the rebidding of the maintenance on two (2) properties in Group C. THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
