AN ORDINANCE AMENDING THE CODE OF ORDINANCES BY ADDING SECTION 2 -287 TO ARTICLE VI AS IT PERTAINS TO REQUIRING LOBBYING CERTIFICATION FOR CONTRACT DOCUMENTS AND INCENTIVE AGREEMENTS (REQUESTED BY COUNCILMEMBER LEWIS) . WHEREAS, Article VI of the Code of Ordinances (Finance) provides a policy relating to the administration of contracts; and WHEREAS, it has been requested that an ordinance providing for a certification process regarding lobbying activities be required as it pertains to all contract documents and incentive agreements. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Article VI of the Code of Ordinances for the City of Port Arthur is hereby amended to add Section 2- 287, as delineated in Exhibit "A ". Section 3. That this being an Ordinance that does not require publication, it shall be effective immediately. Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. All Parties entering into contracts with the City of Port Arthur must complete the following Certification Regarding Lobbying: CERTIFICATION REGARDING LOBBYING The undersigned certifies, to the best of his knowledge and belief that: 1. No funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer of employee of any agency or a member of the City of Port Arthur in connection with the awarding of any contract or incentive agreement. 2. The undersigned shall require that the language of this certification be included in the award documents for all sub - awards at all tiers (including subcontracts, sub - grants, and contracts under grants, loans, and cooperative agreements), and that all Subs shall certify and disclosure accordingly. This certification is material representation of facts which reliance was placed when the transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction. Date: By: s.po6358
