RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 18087, authorizing an
application to the Texas Water Development Board (TWDB) for water line improvement funding
under the State Fiscal Year 2014 Drinking Water State Revolving Fund (DWSRF).
BACKGROUND:
In Resolution 13 -043, the City Council approved the submittal of various water and wastewater
projects for the TWDB 2014 Intended Use Plan (IUP). The purpose of the IUP submittal was to
allow the City to qualify for grants or low interest loans to improve the water and wastewater
infrastructure. This submittal has resulted in the City of Port Arthur receiving an invitation to
apply for funding under the State Fiscal Year 2014 Drinking Water State Revolving Fund.
Applications will be accepted until the total funds available have been committed. They will be
processed in a first -come, first -served manner based on when the application is deemed
administratively complete.
This invitation is for $1,371,297.00 to provide for the planning and design of new water lines.
The application needs to be submitted as soon as possible in order to maximize the City's
chances of receiving these necessary funds.

SUMMARY

RESOLUTION NO.
A RESOLUTION BY THE CITY COUNCIL AUTHORIZING THE
FILING OF AN APPLICATION TO THE TEXAS WATER
DEVELOPMENT BOARD FOR WASTEWATER IMPROVEMENTS
FUNDING UNDER THE STATE FISCAL YEAR 2014 CLEAN WATER
STATE REVOLVING FUND.
WHEREAS, in Resolution 13 -043, the City Council approved the submittal of
various water and wastewater projects for the Texas Water Development Board
(TWDB) 2014 Intended Use Plan (IUP); and,
WHEREAS, the City of Port Arthur received an invitation based on the IUP
submittal (see Exhibit "A ") to apply for funding for the Planning, Acquisition, and Design
phase of a new wastewater treatment plant under the State Fiscal Year 2014 Drinking
Water State Revolving Fund (CWSRF); NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, an application is hereby authorized to be filed with the Texas Water
Development Board applying for funding in the amount of $1,371,297.00 for the
Planning, Acquisition, and Design of water line projects under the State Fiscal Year
2014 Drinking Water State Revolving Fund (CWSRF); and,
THAT, the City Manager is hereby designated the authorized representative of
the City of Port Arthur for the purpose of furnishing such information and executing
such documents as may be required in connection with the preparation and filing of
such application; and,

THAT, the following firms and individuals are hereby authorized and directed to
aid and assist in the preparation and submission of such application and appear on
behalf of and represent the City of Port Arthur before any hearing held by the Texas
Water Development Board on such application, to wit:

Re: State Fiscal Year 2014 Drinking Water State Revolving Fund Invitation
Dear Mr. Blackketter:
This letter serves as official notice that the City of Port Arthur's (City) project is listed on the State
Fiscal Year 2014 Drinking Water State Revolving Fund Intended Use Plan's Invited Projects List to
fund the Design phase of project #9987, totaling $1,371,297. The City is hereby invited to submit an
application for funding to the Texas Water Development Board.
The proposed project is Listed in the Intended Use Plan as being eligible to receive Mainstream
funding. Mainstream funding is loan assistance available at an interest rate of 1.25% below the
market rates, with terms of up to 10 years for planning, acquisition, and design phase funding,
and up to 20 years for construction phase funding.
This State Fiscal Year, the Texas Water Development Board has instituted a first-come, first -served
p ,
application process whereby more projects are invited than there are funds available. The sooner an
entity submits an administratively complete application, the greater opportunity funding will be
available.
Application Dates and Procedures
Applications will be accepted until the total funds available have been committed, or until the State
Fiscal Year 2015 Intended Use Plan is approved by the Board. Notice will be posted on the agency
website of either occurrence.
Applications will be processed in a first -come, first -served manner based on when the application is
deemed administratively complete. More projects are invited than there are funds available;
therefore, the sooner an entity submits an administratively complete application, the greater
opportunity there is to receive funding. Application submittal requirements and the related
application materials may be found on the Texas Water Development Board website at
www.twdb. texas .gov /financial/applications /.
Before the Texas Water Development Board considers a submitted financial application
administratively complete, the City must have conducted a pre- application conference. If you have

if you have completed a pre - application conference for a different project, another conference may be
necessary.
Eligible Phases and Readiness to Proceed
Entities are eligible to apply only for those phases listed in the invitation letter. These phases were
determined based on a review of the Readiness to Proceed to Construction section of the Project
Information Form.
If an entity wishes to apply for construction funding, but the invitation letter does not list the
construction phase as eligible to receive funding this fiscal year, an updated Readiness to Proceed
form (TWDB- 0342), available online at www.twdb.texas.gov/financiallinstructions/doc/TWDB-
0342.docx, must be submitted before submitting a financial application. The Texas Water
Development Board will review the updated form and return a determination of phases eligible for
funding.
For projects to be deemed ready to proceed to construction, all planning and design milestones,
including those related to permitting, acquisition, design, and environmental review, must be
substantially complete. Projects requesting construction funding should have completed all related
planning and design milestones and be ready to proceed to construction at the time of application.
Applying for construction phase funding prior to completing all necessary project milestones may
result in delay of approving the application. Additional information regarding readiness to proceed is
available in the 2014 Drinking Water State Revolving Fund Intended Use Plan.
Other Requirements
Entities that apply for funding must comply with federal requirements, including the Texas Water
Development Board's Disadvantaged Business Enterprise procurement requirements. Please contact
