City Manager /Operations DATE: January 9, 2014 SUBJECT: P.R.18033 — Leachate Hauling COMMENTS RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 18033, authorizing the City Manager to execute the second year of a three year renewable contract with Triangle Waste Solutions of Port Arthur, Texas to provide leachate hauling for the City's Municipal Landfill. The fee will be $53.35 per hour. BACKGROUND: Leachate is the liquid result of biodegradation of the garbage and trash that is placed within the landfill. This leachate is collected in onsite tanks and needs to be transported to the nearest Wastewater Treatment Plant (WWTP). Currently this transportation is done with a vacuum truck by Triangle Waste Solutions. Triangle Waste Solutions has submitted a signed agreement to renew the contract for the second year of the three year contract at a price of $53.35 per hour, which is being increased from last year's rate of $52.00 per hour based on the 2.6% increase in the Consumer Price Index. BUDGETARY/FISCAL EFFECT: Funds are available in the Public Works Landfill Division Budget, account no. 403- 1274 - 533.51- 01. EMPLOYEE /STAFF EFFECT: Acceptance of this recommendation will have no effect on staffing levels at this time. SUMMARY: It is recommended that the City Council approve Proposed Resolution No. 18033, authorizing the City Manager to execute an agreement with Triangle Waste Solutions of Port Arthur, Texas to provide leachate hauling for the City's Municipal Landfill at a rate of $53.35 per hour. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND YEAR OF A THREE YEAR RENEWABLE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND TRIANGLE WASTE SOLUTIONS OF PORT ARTHUR, TEXAS FOR LEACHATE HAULING AT THE CITY LANDFILL FOR A FEE OF $53.35 PER HOUR IN THE NOT TO EXCEED AMOUNT OF $100,000.00. FUNDING IS AVAILABLE IN ACCOUNT NO. 403-1274-533.51-01. WHEREAS, pursuant to Resolution 13 -037, the City entered into a one year agreement with the option to renew for two additional years with Triangle Waste Solutions of Port Arthur, Texas for leachate hauling, who is in agreement to renewal, see attached Exhibit "A "; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager be and he is hereby authorized to execute the second year of a three year contract with Triangle Waste Solutions of Port Arthur, Texas for leachate hauling from the Landfill at a rate of $53.35 per hour, which is being increased from last year's rate of $52.00 per hour based on the 2.6% increase in the Consumer Price Index category "Transportation ", in substantially the same form as attached hereto as Exhibit "A ". THAT, funding is available in account no. 403 - 1274 - 533.51 -01. THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. City Manager /Operations Purchasing Manager v llama RENEWAL CONTRACT FOR HAULING OF LEACHATE THIS AGREEMENT, made this the of , 2014, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY ", and Triangle Waste Solutions , hereinafter called "CONTRACTOR ". WITNESSED: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution 13 -037, the City entered into a one -year contract with the option of renewal for two additional years. The parties hereby agree to exercise said option for a second year. 2. The term of this Contract shall be from February 14, 2014 to February 13, 2015. It shall be renewable by mutual agreement for one additional one year period, with the rates adjusted according to the Consumer Price Index (CPI). Each subsequent yearly contract renewal shall require approval of the City Council. 3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of the materials, supplies, tools, equipment, labor, and other services necessary to connection therewith, excepting those supplies specifically not required on CONTRACTOR in the Specifications. 4. The CONTRACTOR agrees to perform all the work described in the Specifications and contract documents and comply with the terms therein for unit prices as stated below (based on the 2.6% increase in the Consumer Price Index from June 2013 to June 2014): ITEM Tank Truck w/ Operator $ 53.35 /hour Full Load Tank Truck w/ Operator $ 53.35 /hour Partial Load Minimum Hours Charged Per Call -out 4 hours Full or Partial Load 5. The term "Contract Documents" means and includes the following: 1) Agreement 2) Advertisement for Bids * 3) General Information * 4) Specifications * 5) Bid * 6) Bidder's Information Sheet * 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7. IN WITNESS WHEREOF, the parties here to have executed, or caused to be executed by their duly authorized officials, this Agreement in two (2) copies, each of which shall be deemed an original of the date first written above.
