A RESOLUTION AUTHORIZING THE CITY ATTORNEY AND THE CITY MANAGER TO INITIATE CONDEMNATION PROCEEDINGS TO ACQUIRE PROPERTY ON HIGHWAY 87 FOR THE CONSTRUCTION OF A WATER LINE EASEMENT FROM KEITH LAKE TO SABINE PASS STAND PIPE WHEREAS, the City Council considers it a public necessity to construct the S.H. 87 Water System Improvement from Keith Lake to Sabine Pass Stand Pipe and to better serve the citizens of City of Port Arthur; and WHEREAS, per Resolution No.13 -294, the City entered into an agreement with Excavators and Constructors to construct the above referenced project; and WHEREAS, an easement is needed on 2.190 acres of property located in the Dennis Gahagan League, Abstract. No. 123 in Jefferson County, Texas to facilitate the completion of the project; and WHEREAS, the City has completed all of the necessary perquisites to the condemnation process as required by statute; and WHEREAS, the City has obtained an appraisal attached hereto as Exhibit "A" which delineates the value of the property at $1,863. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: z.pr18167 Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Attorney is authorized to take such action as to complete the purchase, and if the purchase is not completed in the immediate future, the City Attorney is herein authorized take such action as to facilitate the formal condemnation process. Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. File No 13-361H0-8664 Dear Mr. Blackketter: At your request and authorization, CBRE, Inc. has prepared an appraisal of the market value of the referenced property. Our analysis is presented in the following Summary Appraisal Report. The subjects are three proposed waterline easements located along the southern right -of -way of Highway 87, west of the town limits of Sabine Pass, Texas. Waterline Easement One is proposed to be 2.190 acres in size, 20 feet wide, and located out of a 667.2 acre parent tract of land. Waterline E Easement Two is proposed to be 0.3442 acres in size, 30 feet wide, and located out of a 13.95 acre I ' parent tract of kind. Waterline Easement Three is proposed to be 0.3332 acre in size, 30 feet wide, and out of a 16.06 acre parent tract of land. The subjects are more fully described, legally and physically, within the enclosed report. For purposes of our analysis, we have first valued the fee simple estate in the whole site of the proposed easements and then have estimated the value of the proposed waterline easement.
