COMEAUX, P.E., INTERIM CITY MANAGER FROM: BEVERLY A. FREEMAN, ACTING DIRECTOR OF HOUSING AND NEIGHBORHOOD REVITALIZATION DATE: FEBRUARY 7, 2014 RE: P.R. 18184 RECOMMENDATION: I recommend City Council adopt P.R. No. 18184 rescinding Resolution No. 13 -516 in its entirety. BACKGROUND: The Housing Division identified and certified the homebuyer as eligible to receive up to $30,000 to assist with the purchase of a new construction home located at 4512 Aspen Lane, Port Arthur, Texas. The funds were to be used to assist with down payment assistance and closing fees associated with the purchase of the home. Resolution No. 13 -516 authorized the execution of a homebuyer's written agreement to receive up to $30,000 for the purchase of a newly constructed home located at 4512 Aspen Lane, Port Arthur, Texas, the City's Homebuyer Assistance Program. After reviewing the identified homebuyers recertification, it has been determined that the identified homebuyer is no longer eligible to receive up to $30,000 down payment and closing cost assistance from the City's Homebuyer Assistance Program to purchase 4512 Aspen Lane, Port Arthur, Texas. BUDGETARY /FISCAL EFFECT: N/A STAFFING /EMPLOYEE EFFECT: Housing Administration staff will be responsible for program administration. SUMMARY: I recommend the City Council adopt P.R. 18184 rescinding Resolution No. 13 -516 in its entirety. P. R. 18184 02/12 /2014 - - BAF /Housing RESOLUTION NUMBER A RESOLUTION RESCINDING RESOLUTION NO. 13 -516 IN ITS ENTIRETY, WHICH AUTHORIZED THE EXECUTION OF A HOMEBUYER'S WRITTEN AGREEMENT FOR THE PURCHASE OF 4512 ASPEN LANE, PORT ARTHUR, TEXAS THROUGH THE CITY'S HOMEBUYER'S ASSISTANCE PROGRAM. WHEREAS, the City Council, by its adoption of Resolution Number 13 -346, (authorizing submission of the 2013 Action Plan) has obligated itself to provide assistance to low and moderate income persons /families; and, WHEREAS, a homebuyer was identified and certified to receive up to $30,000 down payment assistance and closing fees associated with the purchase of a home located at 4512 Aspen Lane, Port Arthur, Texas, from the City's Homebuyer Assistance Program; and WHEREAS, after reviewing the identified homebuyers recertification, it has been determined that the identified homebuyer is no longer eligible to receive up to $30,000 down payment and closing cost assistance from the City's Homebuyer Assistance Program to purchase 4512 Aspen Lane, Port Arthur, Texas; and WHEREAS, the City Council deem it is appropriate to rescind Resolution No. 13 -516 in its entirety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. THAT, the facts and opinions in the preamble are true and correct. Section 2. THAT, Resolution No. 13 -516 is hereby rescinded in its entirety. Section 3. THAT, a copy of the caption of this Resolution be spread up the minutes of the City Council.
