AN ORDINANCE ESTABLISHING THE PUBLIC PURPOSE AND CRITERIA FOR THE DISPOSITION OF PUBLIC PROPEKTY IN THE PORT ARTHUR/JEFFERSON COUNTY ENTERPRISE ZONE AS IT PERTAINS TO THE SALE AND DEVELOPMENT OF THE SABINE HOTEL WHEREAS, Section 2303.513, Texas Government Code, provides that land in a state designated enterprise zone may sell surplus land or buildings in the enterprise zone at less than fair market value if the municipality adopts criteria that specify the conditions and circumstances under which the sale can oc cur and the public purpose to be achieved; and, WHEREAS, the City of Port Arthur does own surplus land and improvements (Sabine Hotel) that it wishes to dispose of; and, WHEREAS, the Sabine Hotel is within a state designated enterprise zone; and, WHEREAS, the City Council desires to adopt criteria that specify the conditions and circumstances in which the sale can occur and the public purpose to be achieved; and, WHEREAS, the City Council desires to sell the Sabine Hotel as to facilitate and revitalize the economic development of downtown Port Arthur, which the City Council considers to be a public purpose. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager or his designee is hereby authorized to issue a request for a proposal for the sale of the Sabine Hotel, in substantially the same form as attached z.po5690 hereto as Exhibit "A', with the criteria being the submission of a development plan which provides for the economic revitalization of the area. Section 3. That the City Secretary shall send a certified copy of this ordinance to the Texas Economic Development Bank. Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. SOKOLOW, CITY ATTORNEY APPROVED FOR ADMINISTRATION: STEVE FITZGIBBONS, CITY MANAGER z.po5690 EXHIBIT "A" EXHIBIT "A" Request For Proposal FOR THE S^!.E AND DEVELOPMENT OF THE SABINE HOTEL The City of Port Arthur, Texas, is requesting written proposals for the purchase and development of the former Sabine Hotel, located at 600 Procter street, Port Arthur, Jefferson County, Texas. The Request for Proposal for this package is organized as follows: I. CONDITIONS FOR PROPOSAL II. PROPOSAL EVALUATION AND SELECTION PROCEDURES III. TIME PERIOD IV. PROPOSAL CONTENT I. CONDITIONS FOR PROPOSAL The proposal submitted must conform to the following specifications: 1. Submittal Information: The proposal must be received in the office of the City Secretary at the following address by 3:00 p.n~ Central Daylight Time on Wednesday November 29, 2006. Specific Project Information: Detailed questions concerning this request should be addressed to: Dale Watson, Director of Planning at (409) 983-8135. II. PROPOSAL EVALUATION AND SELECTION PROCEDURES 1. Evaluation of Proposals: The proposals will be reviewed by City Staff and/or members of the City Council. Proposals will be evaluated on purchase price, proposed use of the building, development plan and schedule, financial capacity, and the economic development and revitalization that k can bring to the City. The City is looking for a proposal which offers the best chance for returning the building to productive activity and revitalize downtown. z.po5690_sablnehotelrequestfor proposal Proposals will be evaluated as follows: a. Bid price b. Proposed use c. Financial viability d. Improvement schedule e. Potential for Economic Development 2. Intervieve.. The top candidates may be invited to make an oral presentation to the City of Port Arthur Staff outlining their proposals. 3. Selection Approva~ The Port Arthur City Council will approve the final selection. 4. City's Right to Reject Proposals: The City of Port Arthur reserves the fight to reject any and all propoials received as a result of this Request for Proposals or to negotiate in any manner necessaryto serve the best Interest of the citizens of Port Arthur and as allowed bySection 2303.513 Texas Government Code. III. TIME PERIOD FOR PROPOSALS The City reserves the fight to extend consideration of the proposals submitted, if k is considered in the best interest of the City. 1. Request for Proposal October 30, 2006 2. Proposals due 3 p.n~ November 29, 2006 3. Review proposals Nov. 30 to Dec. 5, 2006 4. Select proposal December S, 2006 5. Negotiate Sales Contract Dec. 5 to Dec. 12. 2006 6. Council approval of contract December 19, 2006 IV. PROPOSAL CONTENT: The proposal should be brief and not more than twenty (20) pages long. The text should be presented on 8~i inch by 11 inch white paper that has been stapled or bound. The proposed use of the building and redevelopment plan should be presented in detail. The proposals sha~, at a minimum, include the following: 1. Proposed purchase price 2. Proposed use(s) [If mixed use, pmvide a break, down by percentage or square footage] 3. Proposed improvements and budget, including any additional redevelopmem proposed for downtown 4. Redevelopment schedule 5. Proposed financing 6. Previous experience in renovation or redevelopment projects 7. Financial capacity to complete the project. z.poS690_sabinehotelrequestfor proposal 8. Economic Development potential as to revitalize downtown Port Arthur and to create jobs. While purchase price is a consideration, it is the goal of the City of Port Arthur to sell this building to the individual, group, or corporation, which provides the best overall proposal for redevelopment. The City intends to negotiate with the respondent whose proposal is deemed most advantageous to the city. The City may conduct discussions with any or all respondents. These discussions may include, but are not limited to requests for additional information, interviews, modifications, or revisions to the original Request for Proposal; and requests for "best and final" offers. The sale shall be contingent upon execution of an agreement providing for the redevelopment of this building in general conformance with the proposed redevelopment plan in a timely manner. If this redevelopment does not occur, the transaction shall be declared null and void, and ownership shall revert to the City. For this reason, please provide as realistic a redevelopment schedule as possible. V. GENERAL INFORMATION 1. Inspection of the building may be scheduled by calling Dale Watson at (409) 983- 8135 between the hours of 8 a.m. and 5 p.m., Monday through Friday. 2. Miscellaneous plans for the building are available and may be viewed by contacting the above mentioned individual. 3. Phase I and II enviromental assessment surveys have been completed for the presence of asbestos and lead paint. These reports are available and can be viewed by calling the above tamed individual. 4. The following is provided for informational purposes only. (Condition of the structure should be independently verified): a. At least one roof leak. This leak appears to be around a pipe that penetrates the roof. b. Most plumbing fixtures are missing or broken. c. Elevators (2) do not work. Shafts are also flooded. d. All plumbing and electrical fixtures will most likely need to be replaced. e. Property is in a dilapidated condition. 5.
