A RESOLUTION AUTHORIZING THE ADVERTISEMENT FOR BIDS FOR THE SALE OF THE LAND AND IMPROVEMENTS AT 6760 9?a AVENUE WHEREAS, it is deemed in the best interests of the citizens to go out for bids for the sale of the land and improvements at 6760 9th Avenue. WHEREAS, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TEE CITY OF PORT ARTHUR, TEXAS= Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager, or his designee, is authorized to advertise for bids for the sale of the land and improvements at 6760 9th Avenue, with a Notice of Sale, in substantially the same form as delineated in Exhibit ~A" attached hereto and as to the land as described in Exhibit ~B". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. READ, ADOPTED AND APPROVED on this __ day of , A.D., 2006, at a Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: z.pr13835 AYES: Mayor Councilmembers ' ; NOES: MAYOR ATTEST= CITY SECRETARY APPROVED AS TO FORM: CITY ATTORNEY APPROVED FOR ADMINISTRATION: CITY MANAGER z.pr13835 EXHIBIT "A" z.pr13835 NOTICE OF SALE 6760 9TK AVENUE The City of Port Arthur is now accepting sealed bids for the sale of 6760 9th Avenue. Bids will be received at the office of the City Secretary, 444 4th Street or P. O. Box 1079, Port Arthur, Texas, until 3:00 p.m. on December 15, 2006, and all bids received will thereafter be opened and read in the City Council Chambers, 5th Floor City Hall. The City of Port Arthur will sell the property in its current "as is" condition, and with an assignment of its current lease to the YMCA, as well as an assignment of its facility use agreement with First Tee. The new purchaser will be required to assume the obligations of the City as it pertains to said lease with the YMCA and with the Facility Use Agreement with the First Tee Program, as it pertains to the buildings at 6760 9th Avenue. Title to the land and improvements will be conveyed by general warranty deed subject to all restrictions, covenants, conditions, easements, leases, facility use agreement, rights-of-way, mineral and/or royalty reservations of record, if any, and zoning laws affecting this property. The Lease and facility Use Agreement will be conveyed by an assignment in a form to be approved by the City Attorney. The City will reserve appropriate utility easements as needed for public infrastructure. The City reserves the right to reject any and all bids.
