McMahen, P.E., Interim City Engineer DATE: February 24, 2014 RE: Proposed Resolution No. 18211 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18211 authorizing the City Manager to execute Change Order No. 3 to the contract for the Gulf Storage Tanks Project with MK Constructors of Vidor, Texas, in the amount of $6,908.57. BACKGROUND A Hurricane Recovery Grant administered by the Texas General Land Office is funding the majority of this project. This change order is for the substitutions /changes on certain valves at the project site as requested by the Water Utilities Department for technical reasons. Change Order No. 3 does not change the contract time. BUDGET /FISCAL EFFECT Change Order No. 3 increases the contract amount by $6,908.57 to a new total of $1,963,358.57. Funds are available in Project No. I121GST", 144-1201- 532.85- 00, subject to a budget amendment. SUMMARY I recommend that the City Council approve the execution of Proposed Resolution No. 18211. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 3 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND MK CONSTRUCTORS, OF VIDOR, TEXAS, INCREASING THE CONTRACT AMOUNT BY $6,908.57 TO A NEW CONTRACT AMOUNT OF $1,963,358.57, PROJECT NO. I21GST, ACCOUNT NO. 144- 1201 - 532.85- 00. WHEREAS, per Resolution No. 13 -340, the City Council awarded a contract for the Gulf Storage Tanks Project to MK Constructors, of Vidor, Texas; and, WHEREAS, the initial contract amount has been increased from $1,924,900.00 to $1,956,450.00 due to Change Order No. 1 and Change Order No. 2 related to an abandoned water line and two (2) abandoned 6" oil pipelines that were discovered at the project site; and, WHEREAS, the Water Utilities Department has requested the substitution of or changes to certain valves within the project for technical reasons; and, WHEREAS, the project engineer recommends proposed Change Order No. 3 in the amount of $6,908.57, attached as Exhibit "A ", to accomplish this work; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 3 (attached as Exhibit "A ") to the contract between the City of Port Arthur and MK Constructors for substitutions of or changes to certain valves with the project for technical reasons, increasing the total contract amount by $6,908.57; and, P.R. This change order is to change three 12" Flanged Gate Valves from Non - Rising Stem Valves to 12" Flanged Operating Stem and Yoke Rising Stem Valves as requested by The City of Port Arthur Water Utilities Department, Change one 12 ", two 16" and two 24" Keystone Series 61 butterfly valves to Keystone GR Series butterfly valve to meet the National Sanitation Foundation -61 requirements and change three 12" silent check wafer valves to 12" globe valves because they are no longer produced in 12" wafer valves. The total cost for these changes is $6,908.57. I recommend that the City of Port Arthur authorize this change to the contract.
