McMahen, P.E., Interim City Engineer DATE: February 24, 2014 RE: Proposed Resolution No. 18210 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18210 authorizing the City Manager to execute Change Order No. 2 to the contract for the Gulf Storage Tanks Project with MK Constructors of Vidor, Texas, in the amount of $27,650.00. BACKGROUND A Hurricane Recovery Grant administered by the Texas General Land Office is funding the majority of this project. This change order is for the excavation, removal and plugging of an abandoned 6" oil pipeline, and the removal and disposal of 3,600 gallons of residual petroleum material that was found in the 6" pipeline. Additional work included the removal and plugging of a second abandoned 6" diameter oil pipeline that was dry. Both abandoned pipelines were in the way of the project, and no record of them existed. MK Constructors has now submitted documentation for all charges related to the work described. Change Order No. 2 does not change the contract time. • BUDGET /FISCAL EFFECT Change Order No. 2 increases the contract amount by $27,650.00 to a new total of $1,956,450.00. Funds are available in Project No. I121GST, 144- 1201 - 532.85- 00, subject to a budget amendment. SUMMARY I recommend that the City Council approve the execution of Proposed Resolution No. 18210. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 2 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND MK CONSTRUCTORS, OF VIDOR, TEXAS, INCREASING THE CONTRACT AMOUNT BY $27,650.00 TO A NEW CONTRACT AMOUNT OF $1,956,450.00, PROJECT NO. I21GST, ACCOUNT NO. 144- 1201 - 532.85- 00. WHEREAS, per Resolution No. 13 -340, the City Council awarded a contract for the Gulf Storage Tanks Project to MK Constructors, of Vidor, Texas; and, WHEREAS, per Resolution No. 13 -569, Change Order No. 1 to the contract in the amount of $3,900.00, for the removal of 100 feet of an abandoned 6" water line that was discovered to be in the way of the project, was approved, bringing the new contract amount to $1,928,800.00; and, WHEREAS, as work progressed on the project, MK Constructors encountered sections of two (2) abandoned 6" diameter oil pipelines that had to be excavated, removed and plugged, and 3,600 gallons of residual petroleum had to be removed from one of the lines and disposed of; and, WHEREAS, MK Constructors has now submitted documentation for all charges related to the work described; and, WHEREAS, the project engineer recommends proposed Change Order No. 2 in the amount of $27,650.00, attached as Exhibit "A ", to accomplish this work; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. No. 18210 2/24/14 lem Page 2 of 3 THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 2 (attached as Exhibit "A ") to the contract between the City of Port Arthur and MK Constructors for the work described therein, increasing the total contract amount by $27,650.00; and, THAT, Change Order No. 2 increases the contract amount to a new total of $1,956,450.00, and does not change the contract time of the project; and, THAT, Change Order No. 2 will be funded by the Project No. I21GST, 144 -1201- 532.85 -00, subject to a budget amendment; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council. This change order is to excavate, remove and plug two abandoned pipelines and remove approx. 3,600 gallons of oil and contaminated water from one of the abandoned pipelines. The abandoned pipelines were discovered during construction and the remaining material in one of pipelines had to be removed before the pipe could be plugged. The total cost to remove the pipelines and residual liquid material was $27,650.00. I recommend that the City of Port Arthur authorize this change to the contract. 1 have attached Change Order No. 2 which modifies the contract to reflect this change for your consideration and action.
