Comeaux, Interim City Manager FROM: Allison Walker, Public Works Administrative Assistant DATE: March 27, 2014 SUBJECT: P.R.18256 — Slip -form Renewal COMMENTS RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 18256, authorizing the execution of the second year of a three year renewable contract with Hollier Construction for the slip -form placement of concrete for the Public Works Department Streets Division. BACKGROUND: Hollier Construction has submitted a signed agreement to renew the contract for the second year of the three year contract for the slip -form placement of curb and gutter. This contract was awarded on a unit cost basis and will not exceed the amount of $100,000. • BUDGETARY/FISCAL EFFECT: Funds are available in the Public Works Streets Division budget account nos. 001 -1203- 531.36 /51/86 and in the CDBG street project accounts. EMPLOYEE /STAFF EFFECT: None. SUMMARY: It is recommended that the City Council approve Proposed Resolution No. 18256, authorizing the execution of an agreement with Hollier Construction of Groves, Texas to provide the second year of a three year renewable contract for slip -form placement concrete. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND YEAR OF A THREE YEAR RENEWABLE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND HOLLIER CONSTRUCTION OF GROVES, TEXAS FOR SLIP -FORM PLACEMENT OF CONCRETE ON A UNIT COST BASIS FOR THE NOT TO EXCEED AMOUNT OF $100,000.00; ACCOUNT NOS. 001 - 1203 - 531.36/51/86 AND CDBG STREET PROJECT ACCOUNTS. WHEREAS, pursuant to Resolution 13 -104, the City entered into a one year agreement with the option to renew for two additional years with Hollier Construction of Groves, Texas for slip -form placement of concrete curb and gutter, who is in agreement to renew, see attached Exhibit "A "; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager is hereby authorized to execute the second year of a three year contract with Hollier Construction of Groves, Texas for slip -form placement of concrete curb and gutter on a unit cost basis for the not to exceed amount of $100,000; and, THAT, funding is available in account nos. 001 - 1203 - 531.36/51/86 and CDBG street project accounts; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Deborah Echols, CPA Interim City Manager Director of Finance Shawna Tubbs, CPPO Purchasing Manager Exhibit A RENEWAL CONTRACT FOR HAULING OF LEACHATE THIS AGREEMENT, made this the of , 2014, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY ", and Hollier Construction , hereinafter called "CONTRACTOR ". WITNESSED: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution 13 -104, the City entered into a one -year contract with the option of renewal for two additional years. The parties hereby agree to exercise said option for a second year. 2. The term of this Contract shall be from April 8, 2014 to April 7, 2015. It shall be renewable by mutual agreement for one additional one year period. Each subsequent yearly contract renewal shall require approval of the City Council. 3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of the materials, supplies, tools, equipment, labor, and other services necessary to connection therewith, excepting those supplies specifically not required on CONTRACTOR in the Specifications. 4. This contract shall not exceed the amount of $100,000. 5. The term "Contract Documents" means and includes the following: 1) Agreement 2) Advertisement for Bids * 3) General Information * 4) Specifications * 5) Bid * 6) Bidder's Information Sheet * 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7. IN WITNESS WHEREOF, the parties here to have executed, or caused to be executed by their duly authorized officials, this Agreement in two (2) copies, each of which shall be deemed an original of the date first written above.
