BACKGROUND:
The Planning and Zoning Commission is being asked to consider plat approval for the
Breeden Duhamel Subdivision, Lots 1 and 2, Block 1 located north of South Martin Luther
King, Jr. Drive [A.K.A. State Highway 82] and east of South Spoil Levee Road on Pleasure
Island in Port Arthur. The purpose of this plat is to develop "raw" land into two (2)
residential Lots. This subdivision is located in a Heavy Commercial (HC) zoned district. Lot
Dimensions are as follows:

On Sunday, March 23, 2014, six (6) notices were mailed to adjacent property owners
within a 200 ft. radius and the notice was published in the Port Arthur News on Sunday,

7, 2014.

SUBJECT: REPLAT APPROVAL REQUESTED FOR — R14 -09, R14 -10 AND R14-11

BACKGROUND:
Replat requests R14 -09, R14 -10 and R14 -11 have been placed on hold in the Department of
Planning & Zoning for further review.
Public Notices were mailed to adjacent property owners within a 200 ft. radius of said requests
on Sunday, March 23, 2014, as well as published in the Port Arthur News on Sunday, March 1 6,
2014; more than ten (10) days prior to the P &Z public hearing scheduled April 7, 2014.
In accordance with Texas Local Government Code Section 212.009 (a), the municipal authority
responsible for approving plats shall act on a plat within 30 days after the date the plat is filed. A
plat is considered approved by the municipal authority unless it is disapproved within that period.
RECOMMENDATION:
The planning staff recommends tabling replat requests R14 -09, R14 -10 and R14 -1 1.

The site is located north of Aero Drive and west of U.S. Highway 69/96/287. The purpose of this
plat is to create one (1) Tract for Retail Development. This subdivision is located in an Industrial (I)
zoned district.
Owner — Hillister Enterprises, Inc., a Texas Corporation /Umphrey Family Limited Partnership
Engineer /Surveyor — Soutex Surveyors, Inc.
RECOMMENDATION:
The planning staff recommends approval of this request. A final plat cannot be submitted until
engineering plans and other site plans are approved.

STAFFING /EMPLOYEE EFFECT:
None
SUMMARY:
The preliminary plat should be approved as submitted. Any change in layout that will affect
setbacks, water features or traffic flow shall be noted as a new plat and resubmitted to the
Planning and Zoning Commission for approval.

I, Santos Funez, owner of the property described as: 3218 Gulfway Drive, legally described as
Lots 6 and 7, Block 24, Beachway Addition, Port Arthur, Texas, do hereby Withdraw my request
for Specific Use Permit to operate a Wrecker Storage Facility at said location. A zoning

a. APPROVAL OF REPLAT REQUESTS R14 -06, R14 - 07 AND R14 -08
Paul Brown recommended that replat request R14 -06, R14 -07 and R14 -08 be approved.
The motion was made by L Moore, seconded by R. Cox to accept the Planning Staffs
recommendation to approve replat requests R14 -06, R14 -07 and R14 -08.

b. ACCEPTANCE OF ABANDONMENT REQUESTS A14 -01 AND A14 -02
Paul Brown recommended that abandonment requests A14 -01 and A14 -02 be accepted.
The motion was made by R. Cox, seconded by I. Moore to accept the Planning Staffs
recommendation to accept abandonment requests A14 -01 and A14 -02.
Voting Yes: All
Voting No: None
c. APPROVAL OF ZONING REQUEST Z14 -01
Paul Brown recommended that zoning request Z14 -01 be tabled until applicant submits a
written request to withdraw application for specific use permit on the property located at
3217 15th Street (legally described at Lots 11, 12 and 13, Block 24, Beachway Addition, City
of Port Arthur).
The motion was made by I. Moore, seconded by R. Cox to accept the Planning Staff's
recommendation to table zoning request Z14 -01.
Voting Yes: All
Voting No: None
d. MINUTES - FEBRUARY 17, 2014
Upon the motion of 1. Moore, seconded by R. Cox and carried unanimously, the Planning
and Zoning Commission approved the above- mentioned minutes as presented.
