HomeMy WebLinkAboutPR 18258: ONE YEAR CONTRACT WITH TRI CITY EXTERMINATING CO., NOT TO EXCEED $1,500.00 P.R. 18258 03/21/14 CN RESOLUTION NO. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A ONE YEAR CONTRACT WITH TRI CITY EXTERMINATING CO., OF NEDERLAND, TEXAS, IN AN AMOUNT NOT TO EXCEED $1,500.00; FUNDS AVAILABLE IN VARIOUS TRANSIT ACCOUNTS. WHEREAS, there is a need to obtain pest control services for Transit Division facilities; and, WHEREAS, quotes were submitted by various vendors in the vicinity for the provision of these services; and, WHEREAS, specifications were transmitted regarding the sites to be treated and services to be provided; and, WHEREAS, four vendors submitted quotes, with only one vendor from Port Arthur, as delineated in Exhibit "A "; and, WHEREAS, Tri City Exterminating Co., of Nederland, Texas, was the lowest and most responsive bidder in an amount not to exceed amount of $1,500 per year. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, that facts and opinions in the preamble are true and correct. THAT, the City Manager is authorized to enter into the contract with Tri City Exterminating Co., in an amount not to exceed $1,500 per year for pest control services for the Transit's facilities, which include the maintenance building, terminal, and buses, in substantially the same form as attached hereto as Exhibit `B ". THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. FOR THE CITY OF PORT ARTHUR'S TRANSIT DEPARTMENT THIS AGREEMENT, made this the day of 2014, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Tri City Exterminating Company, of Nederland, Texas., herein acting by and through hereinafter called "CONTRACTOR ". WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The term of this contract shall be from April , 2014 to April , 2015. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle with ten (10) days written notice. 2. The Contractor will supply all requirements as per State Law to render pest control as set forth by the U.S. Environmental Protection Agency for the City of Port Arthur Transit. 3. During, the term of this contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor. 4. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the amount not to exceed $1,500.00 /year or $125 /month. 5. Tri -City shall furnish all supervision, labor, materials, and equipment necessary to accomplish the surveillance, trapping and pesticide application components. Tri -City shall also provide detailed site specific recommendations for structural and procedural modifications necessary to achieve pest prevention. Pest included and excluded. Tri -City shall adequately suppress the following pest: • Indoor populations of cockroaches, ants (including, but not limited to, fire ants), flies, spiders and any other arthropod pest not specifically excluded for the contract. (Lighted flytraps are extra) • Populations of the above pest that are located outside of the specified building, but with areas immediately adjacent to building. Populations of the following pest are excluded from this contract: • Termites, carpenter ants and other wood - destroying organisms. • Fungus gnats, drain and phorid flies. • Winged termite swarms emerging indoors. • Mosquitos. • Birds, bats, snakes and all other vertebrates. • Commensal rodents (e.g., Norway and roof rats, house mice). • Pests that primarily feed on outdoor vegetation.
