AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A
GENERAL ELECTION /JOINT HELD MAY 10, 2014 FOR THE PURPOSE OF
ELECTING COUNCILMEMBERS FOR DISTRICTS 1, 2, 3, AND 4, POSITIONS 7
AND 8, AS WELL AS PROVIDING FOR A JOINT ELECTION WITH THE PORT
ARTHUR INDEPENDENT SCHOOL DISTRICT AND ORDERING A RUNOFF ON JUNE
28, 2014, FOR THE PURPOSE OF ELECTING A COUNCILMEMBER FOR DISTRICT
2. PROVIDING FOR THE PUBLICATION OF THE ELECTION ORDER
WHEREAS, the City of Port Arthur is a home rule city with a governing
body composed of a Mayor and eight (8) Councilmembers as delineated below:

WHEREAS, the terms for Districts 1, 2, 3 and 4, as well as for Positions
7 and 8, expired in May 2014; and
WHEREAS, on January 21, 2014, the City Council adopted Ordinance No.

14 -01 that called for a General Election for the purpose of filling the
vacancies in Districts 1, 2, 3, and 4, and for Positions 7 and 8; and
WHEREAS, on April 1, 2014 , the City Council adopted Ordinance No. 14-
11, declaring an unopposed candidate elected for District 3 and providing for
a joint election with the Port Arthur Independent School District and
cancelling the conduct of a Joint Election with the Sabine Pass Port
Authority and the Sabine Pass Independent School District; and
WHEREAS, on March 14, 2014, the City Secretary certified the following
candidates as having filed for office:
For Councilmember District 1: Mike Mason
Raymond Scott, Jr.
For Councilmember District 2: Tiffany L. Hamilton
Cal Jones
Maria Block
For Councilmember District 3: Morris Albright, III
For Councilmember District 4: Laura Miguez
Stephen A. Mosely
For Councilmember Position 7: Reginald D. Trainer, Sr.
Derrick Freeman
For Councilmember Position 8: Lowra A. Reado Harrison
Kerry "Twin" Thomas
Kaprina Richardson Frank
; and
WHEREAS, on April 1, 2014, the City Council adopted Resolution 14 -152 as
to appointing the Counting Station Manager, Tabulation Supervisor, Presiding

Judge, Alternate Judge, Custodian of Records and the Early Voting Ballot
Board; and
WHEREAS, on April 1, 2014 , the City Council adopted Resolution No. 14-
152 as it pertains to designating early voting and election day clerks,
judges and alternate judges; and
WHEREAS, in accordance with the Charter of the City of Port Arthur and
the laws of the State of Texas applicable thereto, a General /Joint Election
was held on Saturday, May 10, 2014, A.D., in the precincts into which the
City of Port Arthur is divided for voting purposes; and
WHEREAS, said election was held for the purpose of allowing the
qualified voters to elect Councilmembers from Districts 1, 2, 3, and 4, and
Positions 7 and 8; and
WHEREAS, the candidates for the Council positions were as follows:
For Councilmember District 1: Mike Mason
Raymond Scott, Jr.
For Councilmember District 2: Tiffany L. Hamilton
Cal Jones
Maria Block
For Councilmember District 3: Morris Albright, III
For Councilmember District 4: Laura Miguez

WHEREAS, the returns of said election for the Councilmembers from
Districts 1, 2, 3, and 4, and for Positions 7 and 8, have been made by Sherri
Bellard, City Secretary TRMC / Election Administrator, to the City Council of
the City of Port Arthur, and the City Council has examined said returns; and
WHEREAS, a Runoff can be called no later than the fifth day after the
final canvass pursuant to Section 2.024 of the Election Code; and
WHEREAS, the City Council has a duty to canvass the returns, pursuant to
Chapter 67 of the Election Code.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
Section 1. That the facts and opinions in the preamble are true and
correct.
Section 2. That the returns of said General Election, after being
canvassed by the City Council, are found and declared to be true and correct.
There were cast at said election for the respective candidates the number of
votes as shown on the tabulated statements that are attached hereto and made
part hereof as Exhibit "A ".
Section 3. That, based on the representations of Sherri Bellard, City
Secretary TRMC / Elections Administrator, that she conducted the Election in
accordance therewith, and based on the presumption under the law that the
election judges are presumed to have done their duty, the City Council has
determined that said General Election was duly called, ordered, and held in

accordance with the Laws of the State of Texas and the Charter of the City of
Port Arthur and Ordinance Numbers 14 -01 and 14 -11, and that the Order ordering
the General Election and the returns thereof, have been made by the proper
officials, and that the May 10, 2014 election resulted in the election of the
following:
Councilmember District 1: Raymond Scott, Jr.
Councilmember District 2: To be determined at the June 28, 2014
Runoff Election
Councilmember District 3: Morris Albright (Unopposed)
Councilmember District 4: Stephen A. Mosely
Position 7: Derrick Freeman
Position 8: Kaprina Richardson Frank
Therefore, Raymond Scott, Jr. is hereby declared to be elected
Councilmember from District 1. That the term for the Councilmember for District
1 shall commence on the date that Raymond Scott, Jr. is duly qualified and shall
expire in May 2017, or until his successor has been elected and duly qualified.
Therefore, Morris Albright has been declared elected as Councilmember from
District 3. That the term for the Councilmember for District 3 shall commence
on the date that the candidate is duly qualified and shall expire in May 2017,
or until his successor has been elected and duly qualified.
Therefore, Stephen A. Mosely is hereby declared to be elected as
Councilmember from District 4. That the term for the Councilmember for District
4 shall commence on the date that the candidate is duly qualified and shall
expire in May 2017, or until his successor has been elected and duly qualified.
Therefore, Derrick Freeman is hereby declared to be elected as
Councilmember from Position 7. That the term for the Councilmember for Position

7 shall commence on the date that the candidate is duly qualified and shall
expire in May 2017, or until his successor has been elected and duly qualified.
Therefore, Kaprina Richardson Frank is hereby declared to be elected as
Councilmember from Position 8. That the term for the Councilmember for Position
8 shall commence on the date that the candidate is duly qualified and shall
expire in May 10, 2017, or until her successor has been elected and duly
qualified.
Section 4. That it is declared that there were more than two (2)
candidates for the office of Councilmember from District 2 and no candidate
received a majority of all votes cast for the office of Councilmember from
District 2. Tiffany L. Hamilton and Cal Jones are presently the two (2)
candidates who received the highest number of votes for District 2.
Section 5. That pursuant to Section 2.025 Election Code, V.T.C.A.,
the Runoff shall be held not earlier than the 20 day or later than the
45 day after the date the final canvass of the main election is
completed.
Section 6. That the Special Runoff Election shall be held on Saturday,
June 28, 2014, for the purpose of electing the position of Councilmember from
District 2.
Section 7. That once elected, the term of the new Councilmember from
District 2 shall commence on the date that the candidate is duly qualified and
shall expire on May 2017, or until his /her respective successor shall have been
duly qualified.
Section 8. That the Order and Notice of the Runoff Election shall be
made and shall be published as provided for in the Election Code, V.T.C.A.,

substantially in accordance with Exhibit "B" and "B -1 ", attached hereto and made
a part hereof. A copy of this Ordinance, together with a copy of said Order and
Notice attached as Exhibit "B" and "B -1 ", shall be filed in the office of the
City Secretary and another copy shall be posted on a bulletin board in the
office of the City Secretary and on the bulletin board in the lobby of the City
Hall Building at least fifteen (15) days before the Runoff Election.
Section 10. That pursuant to Section 67.003 of the Election Code, the
City Council of the City of Port Arthur shall meet on July 9, 2014 , at 10:00
a.m., and officially canvass the returns and declare the results of said Runoff
Election for Councilmember from District 2. The respective candidate receiving
a majority of the votes cast at said Runoff Election shall be declared to be
elected as Councilmember from District 2.
Section 11. That the City Council shall therefore be composed of the
following members:

* Councilmember Segler shall continue to serve until a successor is selected as a result
of the June 28, 2014 Runoff Election.
Section 12. That this being an Ordinance for which publication is not
required under the Charter of the City of Port Arthur, it shall not be
published, but shall take effect and be in force immediately from and after
its passage.
Section 13. That a copy of the caption of this Ordinance be spread upon
the Minutes of the City Council.

ORDER AND NOTICE
OF A RUNOFF ELECTION
IN THE CITY OF PORT ARTHUR, TEXAS
JEFFERSON COUNTY TEXAS
Notice is hereby given that the City of Port Arthur will hold a Runoff Election, June 28, 2014,
between the hours 7:00 a.m. and 7:00 p.m.
I, Deloris "Bobbie" Prince, Mayor of the City of Port Arthur, Texas, as authorized by the City
Council, do hereby Order and give Notice of a Runoff Election to be held in the City of Port Arthur, Texas,
on Saturday, June 28, 2014, between the hours of 7:00 a.m. and 7:00 p.m., for the purpose of electing a
Councilmember for District 2. The term of office for the Councilmember will be for three (3) years and
until his /her respective successor shall have been elected and duly qualified.
Said election shall be by Electronic Voting System as provided in Section 123.001 of the Election
Code, Section 9.004, et seq., Local Government Code and the City Charter. The location of each Election
Day polling place is shown on Exhibit "B -1 ". Early voting by personal appearance will be conducted each
weekday at the following locations between the hours of 8:00 a.m. and 5:00 p.m. beginning on June 16,
2014 through June 20, 2014 and June 23 through June 24, 2014:
City Hall, 444 Fourth Street
Port Arthur Public Library, 4615 Ninth Avenue
Extended hours for Early Voting by personal appearance will be conducted on Friday June 20,
2014, and on Tuesday, June 24, 2014, between the hours of 8:00 a.m. and 8:00 p.m. at the following
location of the main early voting polling place:

If you requested a mail ballot during the General Election and live in the applicable precincts for the
District 2 Runoff Election a mail ballot will automatically be sent to you.
