RECOMMENDATION
I recommend that the City Council approve Proposed Resolution No. 18335 authorizing
the extension of the current contract with Soutex Surveyors from July 31, 2013 to July
31, 2014, to continue and complete the engineering and construction management
services for the construction of a new concession stand at County Park in Port Acres,
and at no additional cost to the City.
BACKGROUND
In Resolution No. 13-123, the City entered into a contract with Soutex Surveyors and
Engineers for engineering and construction management services for the construction of
a concession stand at County Park in Port Acres, said contract being in the amount not-
to-exceed $11,750.00, beginning on March 26, 2013 and ending on July 31, 2013. The
bid award for the County Park concession stand project was not made until October 15,
2013 and work did not proceed until November 11, 2013, and work continues to this
day. It is expected that work on the concession stand will be completed by mid-June,
with necessary finish-up work and paperwork processing taking place thereafter.
Extension of Soutex's contract until July 31, 2014 will allow sufficient time to complete
the close-out of the concession stand project.
BUDGET/FISCAL EFFECT
None, other than to amend the ending date of Purchase Order No. 173147 as noted
above.
SUMMARY
. I recommend that the City Council approve Proposed Resolution No. 18335 that would
,., extend Soutex Surveyors and Engineers' professional services contract for the
concession stand project at Pioneer Park - Grado Field from its current ending date of
July 31, 2013 to July 31, 2014, at no additional cost to the City.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE A CONTRACT EXTENSION BETWEEN
THE CITY OF PORT ARTHUR AND SOUTEX
SURVEYORS AND ENGINEERS FOR THE PURPOSE OF
PROVIDING CERTAIN PROFESSIONAL SERVICES
RELATED TO THE CONSTRUCTION OF A
CONCESSION STAND AT COUNTY PARK, AND AT NO
ADDITIONAL COST TO THE CITY.
WHEREAS, per Resolution No. 13-123, the City of Port Arthur entered into a
professional services contract with Soutex Surveyors and Engineers of Port Arthur, Texas, for
the purpose of providing design and construction management services for the construction of a
concession stand at County Park, said contract being for an amount not-to-exceed $11,750.00,
and with a starting date of March 26, 2013 and an ending date of July 31, 2013; and,
WHEREAS, as a result of the construction on the concession stand not beginning until
November 11, 2013, and continuing to this day, Soutex Surveyors and Engineers has exceeded
their contract time even though they continue to provide the necessary professional services for
the project; and,
WHEREAS, an extension of the contract time for Soutex Surveyors and Engineers is
necessary to allow them to provide the necessary professional services for the project and for all
close-out procedures; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to
execute, on behalf of the City of Port Arthur, the Contract Extension agreement

(attached as Exhibit "A") to the contract between the City of Port Arthur and Soutex Surveyors
and Engineers, which would extend the ending date of the contract to July 31, 2014; and,
THAT,there will be no additional cost to the City for this contract as a result of the time
extension to July 31, 2014; and,
THAT, a copy of the caption of this resolution be spread upon the minutes of the City
Council.

CONTRACT EXTENSION FOR
DESIGN AND CONSTRUCTION MANAGEMENT SERVICES
FOR CONSTRUCTION OF A NEW CONCESSION STAND
AT COUNTY PARK IN PORT ARTHUR,TEXAS
THIS AGREEMENT, made this day of , 2014, by and
between the City of Port Arthur, a municipal corporation organized under the laws of the
State of Texas, hereinafter called "City", and Soutex Surveyors and Engineers, a
corporation herein acting by and through Anthony Leger, RPLS, Vice President,
hereinafter called"Contractor".
WITNESSETH: That for and in consideration of the payment, terms, conditions, and
agreements set forth herein, City and Contractor agree as follows:
1. Pursuant to Resolution 13-123, the City and Contractor entered into a contract for
certain professional services which began on March 26, 2013 and ended on July 31,
2013.
2. The City and Contractor agree to extend the contract until July 31, 2014 to allow
Soutex to complete the necessary professional services required for the construction
of the concession stand at County Park at no additional cost to the City.
3. This Agreement shall be binding upon all parties hereto and their successors and
assigns.
4. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be
executed by their duly authorized officials,this Agreement in two (2) copies, each of
which shall be deemed an original, on the date first written above.
