McMahen, P.E., Interim City Engineer DATE: May 14, 2014 RE: Proposed Resolution No. 18336 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18336 that would authorize the Interim City Manager to execute Change Order No. 1 to the contract with Basco Construction, Inc., for construction of one (1) concession stand at Pioneer Park — Grado Field and one (1) concession stand at County Park, extending the time of said contract by fifty-five (55) calendar days. BACKGROUND By Resolution 13-463 dated October 15, 2013, the City Council awarded a contract to Basco Construction, Inc., of Nederland, Texas, in the amount of $304,654.00, for the construction of one (1) concessions stand at Pioneer Park — Grado Field and one (1) concession stand at County Park in Port Acres. The contract time per the contract was 150 calendar days, with the Notice to Proceed being November 11, 2013. Work on both concession stands is nearing completion, with the one at County Park being substantially complete, even though Basco has exceeded the contract date of completion for the project, that being April 9, 2014. Bacso has requested a time extension due to rain and ice conditions, and has supplied documentation for that request. The project engineer, Soutex Surveyors and Engineers has verified the documentation and has determined that fifty-five (55) calendars should be added to the contract time. The new completion date by the addition of the fifty-five (55) calendars days approved would be June 3, 2014. BUDGET/FISCAL EFFECT There is no change in the contract amount as a result of Change Order No. 1, though Purchase Order No. 179021 will need to be amended to reflect the new ending date of the contract. SUMMARY I recommend that the City Council approve Proposed Resolution No. 18336 that would authorize the Interim City Manager to execute Change Order No. 1 to the construction contract with Basco Construction, Inc., for a time extension to the contract by fifty-five (55) calendar days to June 3, 2014. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND BASCO CONSTRUCTION, INC., OF NEDERLAND, TEXAS, FOR THE CONSTRUCTION OF TWO (2) CONCESSION STANDS IN CITY PARKS, INCREASING THE TIME OF THE CONTRACT AMOUNT BY FIFTY- FIVE (55) CALENDAR DAYS. WHEREAS, per Resolution No. 13-463, the City Council awarded a contract for the construction of two (2) concessions stands in City parks to Basco Construction, Inc., of Nederland, Texas; and, WHEREAS, the construction of one (1) concession stand at Pioneer Park— Grado Field and one (1) concession stand at County Park began on November 11, 2013, with a contract time of 150 calendar days and an ending date of April 9, 2014; and, WHEREAS, the purchase order issued for the project has a completion date of May 31, 2014; and, WHEREAS, Basco Construction, Inc., had requested a time extension of fifty-five (55) calendars days to their contract for rain and ice conditions during the construction period; and, WHEREAS, our project engineer, Soutex Surveyors and Engineers, has examined the request and recommends proposed Change Order No. 1 in the amount of fifty-five (55) calendar days to be added to the contract time for Basco Construction, Inc, said Change Order No. 1 being attached as Exhibit"A": and, WHEREAS, the new ending date for Basco Construction, Inc.'s contract would be June 3, 2014, if the Change Order is approved; NOW THEREFORE, P.R. No. 18336 5/14/14 tern Page 2 of 3 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 1, attached as Exhibit "A", to the contract between the City of Port Arthur and Basco Construction, Inc., for the extension of said contract by fifty-five (55) calendar days, with the new ending date of the contract being June 3, 2014; and, THAT, Change Order No. 1 does not increase the contract amount; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
