RECOMMENDATION
I recommend that the City Council approve Proposed Resolution No. 18341
acknowledging the acceptance of the Engineer's Certificate of Substantial Completion.
For the Highway 87 water line project with Excavators & Constructors, LTD., of Port
Arthur, Texas.
BACKGROUND
This Hurricane Recovery Grant administered by the Texas General Land Office will fund
this project to extend 16"720" water transmission mains from the Intracoastal Canal to
Keith Lake along SH 87 South. This is a key step in improving the reliability and
capabilities of the public water system serving the Sabine Pass area. It has eliminated
the section of line that was 'floating' in the Keith Lake cut adjacent to'the bridge.
BUDGET/FISCAL EFFECT
This project was funded through the GLO Project no. I21 SPW, 144-1201-532.59-00.
SUMMARY
I recommend that the City Council approve Proposed Resolution No.18341.

RESOLUTION NO.
A RESOLUTION ACKNOWLEDGING THE
ACCEPTANCE OF THE ENGINEER'S CERTIFICATE
OF SUBSTANTIAL COMPLETION AND SUBSTANTIAL
COMPLETION INSPECTION PUNCH LIST FOR THE
HIGHWAY 87 WATERLINE PROJECT WITH
EXCAVATORS & CONSTRUCTORS, LTD., OF PORT
ARTHUR,TEXAS.
WHEREAS, per Resolution No. 13-294, the City entered into a contract for the
installation of a water transmission line along Highway 87 South with Excavators &
Constructors,Ltd. for the contract amount of$2,318,702.50 and a term of 270 days; and,
WHEREAS, per Resolution No. 13-400, the City Council authorized Change Order No.
1 between the City and Excavators & Constructors, Ltd and Change Order No. 1 with the GLO
for the Hwy 87 water transmission line tracer wire system increasing the contract amount by
$64,286.50 to a new total of$2,382,989; and,
WHEREAS, per Resolution No. 14-043, the City Council authorized Change Order No.
2 between the City and Excavators & Constructors, Ltd and Change Order No. 2 with the GLO
that the Texas Department of Transportation has requested six (6) fire hydrants be replaced with
underground blow-off hydrants for the installation of a Water Transmission Line along Highway
87 South increasing the contract amount by $23,760.00 to a new total of $2,406,749.00,
increasing the contract time by twelve (12) days to a total of 282 days; and,
WHEREAS,per Resolution No. 14-153, the City Council authorized Change Order No. 3
between the City and Excavators & Constructors, Ltd and Change Order No. 3 with the GLO for
a seventeen(17)day time extension increasing the term to 299 days; and,
WHEREAS, the Engineer's Certificate of Substantial Completion date of May 1, 2014
applies to all work under the contract documents or to the following specified parts thereof,
between the City of Port Arthur and Excavators & Constructors,Ltd.; and,

WHEREAS, on May 1, 2014 the work which this certificate applies has been inspected
by Arceneaux & Gates Consulting Engineers, the Utility Operations Department and Excavators
& Constructors, Ltd., and is hereby declared to be substantially complete in accordance with the
Contract Documents (attached as Exhibit"A"); and,
WHEREAS,the Substantial Completion Inspection Punch List for the Highway 87 water
line project (attached as Exhibit `B") are to be corrected to comply with the Contract
Documents; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the City Council hereby acknowledges the acceptance of the Engineer's
Certificate of Substantial Completion for the Highway 87 water line project with Excavators &
Constructors, LTD., in the total amount of$2,406,749.00, a contract term of 299 days, with a
contract completion date of May 14 2014; and,
THAT, Arceneaux & Gates Consulting Engineers, and Excavators & Constructors, Ltd.,
will submit a the Certificate of Completion, Contractors Certificate of Release and final payment
for the contract after the punch list has been completed for City Council approval; and
THAT, The Acceptance by the CONTRACTOR of final payment shall be and shall
operate as a release to the OWNER of all claims and all liability to the CONTRACTOR for all
things done or furnished in connection with this work and for every act and neglect of the
OWNER and others relating to or arising out of this work. No payment, however, final or
otherwise, shall operate to release the CONTRACTOR or his Sureties from any obligations
under this Contract or the Performance and Payment Bonds.
THAT, a copy of the caption of this resolution be spread upon the minutes of the City
Council.

complete all the Work in accordance with the Contract Documents. The items in the tentative list
shall be completed or corrected by Contractor within 30 days of the above Date of Issuance. From
the date of Substantial Completion the responsibilities between Owner and Contractor for security,
operation, safety, maintenance, heat, utilities, insurance and warranties and guarantees shall be as
follows:

RESPONSIBILITIES
OWNER: Operation of the constructed facilities.
CONTRACTOR: Security, Safety, Maintenance,Insurance, Warranties and Guarantees of the
constructed facilities. Contractor shall complete a punch list which will be
generated at an inspection of the facilities with the Owner and Engineer at a
date to be determined.
This certificate does not constitute an acceptance of Work not in accordance with the Contract
Documents, nor is it a release of Contractor's obligation to complete the Work in accordance with
the Contract Documents.

The following items are to be corrected or completed to comply with the Contract Documents:
GENERAL ITEMS
1. Remove any leftover material under the Intracoastal Bridge.
2. Smooth and dress up dirt around air release valve manholes, extend fill on north
and south side of manholes to eliminate "launch ramps".
3. Verify a minimum 2% slope from edge of road to air release valve manholes.
4. Remove air release valve and manhole at STA 34+00.
5. Lower valve elevations at STA 34+00 to provide a minimum 2% slope from the
edge of road.
6. Smooth and dress up grading at locations without vegetation and apply seeding to
the areas without vegetation.
7. Relocate all valve and terminal markers to be a minimum of 30' from edge of
road,where valve markers cannot be relocated outside of the 30' clear zone blue
surface mount markers may be used at the edge of the road to.
