Comeaux, P.E., Interim City Manager FROM: Allison Walker, Public Works Administrative Assistant DATE: May 28, 2014 SUBJECT: P.R. 18357—Debris Removal for Emergency Event COMMENTS RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 18357, authorizing City Manager to execute the third and final year of the agreement with Crowder Gulf of Theodore, Alabama for debris removal and emergency services. BACKGROUND: This is the third and final year of the agreement with Crowder Gulf of Theodore, Alabama for debris removal and emergency services. This contract was approved by the City Council by Resolution No. 12-310 and renewed by Resolution No. 13-252, in order to provide for emergency services in the event of a disaster. BUDGETARY/FISCAL EFFECT: Funding will be provided for in the appropriate disaster/emergency recovery project accounts. EMPLOYEE/STAFF EFFECT: None. SUMMARY: It is recommended that the City Council approve Proposed Resolution No. 18357, authorizing City Manager to execute the third and final year of the agreement with Crowder Gulf of Theodore, Alabama for debris removal and emergency services. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE THIRD AND FINAL YEAR OF THE AGREEMENT WITH CROWDER GULF OF THEODORE, ALABAMA, FOR DEBRIS REMOVAL AND EMERGENCY SERVICES FOR THE CITY OF PORT ARTHUR IN THE EVENT OF AN EMERGENCY OR DISASTER. WHEREAS, it is deemed in the best interest of the City of Port Arthur to have a service in place for debris removal and emergency services in the event of an emergency or a disaster; and, WHEREAS, pursuant to Resolution 12-310, the City entered into a one year agreement with the option to renew for two additional years with Crowder Gulf of Theodore, Alabama; and, WHEREAS, pursuant to Resolution 13-252, the City renewed the agreement for the second year(1St renewal); and, WHEREAS, this is the third and final year of the contract with Crowder Gulf; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, THAT, the City Manager is hereby authorized to execute the third and final year of the contract attached hereto as Exhibit "A" with Crowder Gulf of Theodore, Alabama, for debris removal and emergency services for the City of Port Arthur on a unit price basis; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. E. eborah Echols, CPA Interim City Manager Director of Finance Wy2-fAJ-14 a_riff) Shawna Tubbs, CPPO Purchasing Manager Exhibit "A" CONTRACT FOR DEBRIS REMOVAL & EMERGENCY SERVICES FOR THE CITY OF PORT ARTHUR THIS AGREEMENT, made this the day of , 2014, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY", and Crowder Gulf a(n) corporation herein acting by and through John Ramsay, President hereinafter called"CONTRACTOR". WITNESSED: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution 12-310,the City entered into a one-year contract with the option of renewal for two additional years. The parties hereby agree to exercise said option for the third and final year. 2. Upon receipt of the Notice to Proceed, the CONTRACTOR shall initiate work under this contract within 24 hours. The term of this contract shall be for the duration of the emergency or disaster recovery period as determined by the City Council of the City of Port Arthur. 3 The term of this Contract shall be from July 18, 2014 to July 17, 2015. 4. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of the materials, supplies,tools, equipment, labor, and other services necessary in connection therewith, excepting those supplies specifically not required of CONTRACTOR in the Specifications items mentioned in the attached Proposal. 5. The term "Contract Documents"means and includes the following: (A) Agreement (B) Invitation to Bid Request for Proposal* (C) General Information* (D) Specifications* (E) Bid Proposal* (F) Bidder's Information Sheet* * These items were attached to the original letting contract. The agreement only is included for this renewal. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7. IN WITNESS WHEREOF, the parties here to have executed, or caused to be executed by their duly authorized officials, this Agreement in two (2) copies, each of which shall be deemed an original of the date first written above.
