McMahen, P.E., Interim City Engineer--� DATE: June 4, 2014 RE: Proposed Resolution No. 18367 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18367 which would authorize the City Manager to execute Change Order No. 2 to the contract between the City and Basco Construction, Inc., for the construction of two concession stands at City parks, and to accept the Certificates of Substantial Completion issued for both projects by Soutex Surveyors and Engineers. BACKGROUND The City contracted with Basco Construction to build two concessions stands, one in County Park and one in Pioneer Park-Grado Field in the amount of $304,654.00, with a contract term of 150 calendar days. Change Order No. 1 to the contract was previously approved for fifty-five (55) additional calendar days, and Change Order No. 2 would add another seven (7) calendar days, for a new completion date of June 10, 2014. The Certificates of Substantial Completion stop the count of days on the term of the contract on June 2, 2014. Minor punch list items remain to be done, but they do not affect the use of the concession stands. All punch list items must be completed to the City's satisfaction and in accordance with the contract documents before the City will process the contract for close-out and final payment to Basco. BUDGET/FISCAL EFFECT There is no change in the contract amount as a result of Change Order No. 2, though Purchase Order 179021 should be amended to reflect a new ending date of the Purchase Order at June 10, 2014. SUMMARY I recommend that the City Council approve Proposed Resolution No.18367 which would authorize the execution of Change Order No. 2 to the Basco contract, and which would accept the two Certificates of Substantial Completion issued by Soutex Surveyors and Engineers for the projects. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 2 FOR A TIME EXTENSION TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND BASCO CONSTRUTION, INC., OF NEDERLAND, TEXAS, AND ACCEPTING THE TWO CERTIFICATES OF SUBSTANTIAL COMPLETION FOR THE CONCESSION STANDS CONSTRUCTED AS PART OF SAID CONTRACT. WHEREAS, per Resolution No. 13-463, the City entered into a contract with Basco Construction, Inc. of Nederland, Texas, for the construction of a concession stand at County Park and a concession stand at Pioneer Park-Grado Field, for the contract amount of$304,654.00 and a term of 150 calendar days; and, WHEREAS, per Resolution No. 14-329, the City Council authorized Change Order No. 1 between the City and Basco Construction, Inc., for a time extension of fifty-five (55) calendar days, increasing the term of the contract to 205 calendar days, with a new completion date of June 3, 2014; and, WHEREAS, Basco Construction, Inc., has submitted Change Order No. 2 to their contract, attached as Exhibit "A", for an additional time extension of seven (7) calendar days; and, WHEREAS, on May 7, 2014, the City, Soutex Surveyors and Engineers, and Basco Construction, Inc., made a walk-through on the County Park concession stand project and established a punch list of items to be addressed by Basco Construction, Inc.; and, WHEREAS, on May 14, 2014, Soutex Surveyors and Engineers submitted to the City a Certificate of Substantial Completion for the concession stand at County Park, attached as Exhibit `B", the effective date of which was May 6, 2014, when Basco Construction, Inc. gave permission to the Port Acres Little League permission to begin using the concession stand; and, P. No. 18367 06/03/141em Page 2 of 4 WHEREAS, there are some incidental punch list items that remain to be addressed, but which do not prevent the use of the concession stand by the Port Acres Little League; and, WHEREAS, on May 29, 2014, the City, Soutex Surveyors and Engineers, and Basco Construction, Inc., made a walk-through on the Pioneer Park-Grado Field concession stand project and established a punch list of items to be addressed by Basco Construction, Inc.; and, WHEREAS, on June 2, 2014, Soutex Surveyors and Engineers submitted to the City a Certificate of Substantial Completion for the concession stand at Pioneer Park-Grado Field, attached as Exhibit"C", the effective date of which was June 2, 2014, when Basco Construction, Inc. gave permission to the Port Arthur Little League to begin using the concession stand; and, WHEREAS, there are some incidental punch list items that remain to be addressed, but which do not prevent the use of the concession stand by the Port Arthur Little League; and, WHEREAS, all incidental punch list items must be completed by Basco Construction, Inc., to the satisfaction of the City, and in compliance with the contract documents, before the City will process the close-out of Basco's contract and make final payment to Basco; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager is hereby authorized to execute Change Order No. 2 to the contract between the City and Basco Construction, Inc., for the construction of two (2) concession stands, increasing the contract time by seven (7) calendar days to a contract term of 212 calendar days, for a new completion date of June 10, 2014; and, THAT, the City Council hereby accepts the Certificate of Substantial Completion issued by Soutex Surveyors and Engineers for the County Park concession stand, and dated May 14, 2014, with an effective date of May 6, 2014; and, P. No. 18367 06/03/14 lem Page 3 of 4 THAT, the City Council hereby accepts the Certificate of Substantial Completion issued by Soutex Surveyors and Engineers for the Pioneer Park-Grado Field concession stand, and dated June 2, 2014, with an effective date of June 2, 2014; and, THAT, acceptance of the Certificates of Substantial Completion by the City stops the count of days on the term of the contract as of June 2, 2014; and, THAT, Soutex Surveyors and Engineers, and Basco Construction, Inc., will submit a Certificate of Completion, Contractor's Certificate of Release and final payment for the contract, after the punch lists for the concession stands have been completed, for City Council acceptance and approval; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
