ORDINANCE NO.
AN ORDINANCE AS IT PERTAINS TO SECTION 10-202
OF THE CODE OF ORDINANCES AS IT PERTAINS TO
VICIOUS ANIMALS, PROVIDING A MINIMUM FINE, AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, pursuant to Section 54.001 of the Local Government
Code:
(a)
The governing body of a municipality may enforce
each rule, ordinance, or police regulation of the
municipality and may punish a violation of a rule,
ordinance, or police regulation.
A fine or penalty for the violation of the rule,
ordinance, or police regulation may not exceed
$500. However, a fine or penalty for the violation
of a rule, ordinance, or police regulation that
governs fire safety, zoning, or public health and
sanitation, including dumping of refuse, may not
exceed $2,000.
This section applies to a municipality regardless
of any contrary provision in a municipal charter.

WHERP~AS, the City Council deems it in the public interest to
provide for a minimum fine as it pertains to the keeping, owning,
or harboring of vicious animals within the City limits of the City
of Port Arthur.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1.
That the facts and opinions in the preamble are
true and correct.
Section 2. That Section 10-202 of the Code of Ordinances

is hereby amended as delineated in Exhibit "A", attached hereto.
Section 3. That this Ordinance or its caption and penalty
shall be published at least one (1) time within ten (10) days after
final passage hereof in the

Section 4. That this
official newspaper of the City of Port
Ordinance shall take effect
immediately after the date of such publication.

No person shall keep, own, or harbor any vicious animal
within the city limits.
For the first offense of the owner, the minimum fine
shall be $250.
For the second offense of the owner, the minimum fine
shall be $500. This minimum fine shall be imposed
regardless of whether the owner has a different dog.
