BACKGROUND:
The Planning and Zoning Commission is requested to review and consider a request to
abandon approximately 0.5299 acre of land consisting of the following:
•20'wide alley right-of-way within Block 22,Town of Griffing;
•10'wide alley right-of-way located within and adjacent to the Old Interurban right-
of-way,Block 5,Town of Griffing;
•20'wide and 10'wide alley rights-of-way located within and adjacent to the Old
Interurban right-of-way,Block 17,Town of Griffing;
•50'wide street-right-of-way consisting of an unimproved portion of 26th Street
adjacent to Blocks 17 and 26,Town of Griffing.
This request is being made by The Hughen Center,Inc.,the adjacent property owner.The
purpose of the abandonments is to continue upkeep and for future development.
Access to the adjacent properties will not be impeded as a result of the closings.The
Hughen Center,Inc.owns all properties adjacent north and south of the rights-of-way that
the abandonments being requested;therefore no residential property shall be affected by
this permanent closure.
On Friday,June 27,2014,thirty-six (36)notices were mailed to adjacent property owners
within a 200 ft.radius and the notice was published in the Port Arthur News on Sunday,
June 22,2014,more than ten (10)days prior to the P&Z public hearing scheduled for July 7,
2014.

RECOMMENDATION:
The Planning staff has no objections to the recommendation of the abandonments;
however,The Hughen Center,Inc.will be responsible for any cost associated with utility
relocations as part of total abandonment of easements,along with the following
stipulation:
•The relocation of utility easements will be required to be completed before the City
of Port Arthur transfers said easements (at appraised value)by special warranty
deed,after which application for building plans for review and permitting may be
submitted.
The Hughen Center,Inc.desires a permanent closure and abandonment of the alley right-
of-ways;therefore,The Hughen Center,Inc.shall abide by Section 94-381 et.seq.of the
Code of Ordinances and request and abandonment thereof,obtain an appraisal,and follow
the procedures.
