McMahen, P.E., Interim City Engineer DATE: July 11, 2014 RE: Proposed Resolution No. 18404 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18404 accepting certain contract documents from Basco Construction, Inc., for the County Park and Pioneer Park Concessions Stands project, authorizing the City Manager to sign the Certificate of Acceptance for the project, and making final payment to the Contractor. BACKGROUND On October 15, 2013, the City contracted with Basco Construction, Inc., of Nederland, Texas, for the construction of two concessions stands, one in County Park and one at Pioneer Park—Grado Field, in the total amount of $304,654.00. Work on the concession stands was substantially complete on June 2, 2014, with all clean-up, etc., complete on June 10, 2014. Basco and Soutex Surveyors & Engineers have submitted all necessary documents to close the project out, and Basco had submitted its Invoice No. 9 and FINAL in the amount of$15,232.70. BUDGET/FISCAL EFFECT Funding for this particular project is provided in Account Numbers 120-1429-582.59-05 ED1302 and 120-1429-582.59-05 ED1305, from which the Invoice No. 9 and FINAL will be paid. A RESOLUTION AUTHORIZING ACCEPTANCE OF THE ENGINEER'S CERTIFICATE OF COMPLETION, CONTRACTOR'S CERTIFICATE AND RELEASE, AND CONTRACTOR'S CERTIFICATE OF GUARANTEE FOR THE CONSTRUCTION OF CONCESSION STANDS IN COUNTY PARK AND PIONEER PARK, AND AUTHORIZING THE CITY MANAGER TO SIGN THE CERTIFICATE OF ACCEPTANCE ON BEHALF OF THE CITY OF PORT ARTHUR, TEXAS, AND TO MAKE FINAL PAYMENT TO THE CONTRACTOR. PROJECT NUMBERS 120-1429-582.59-05 ED1302 AND 120-1429-582.59-05 ED1305. WHEREAS, the City of Port Arthur has received for the County Park and Pioneer Park Concession Stands project an Engineer's Certificate of Completion dated July 10, 2014, from Stanley G. Newsome, P.E., of Soutex Surveyors & Engineers (attached as Exhibit "A"); a Contractor's Certificate and Release dated July 9, 2014, from Basco Construction, Inc. (attached as Exhibit `B"); a Contractor's Certificate of Guarantee dated July 9, 2014, from Basco Construction, Inc. (attached as Exhibit "C") all certifying that the County Park and Pioneer Park Concessions Stands project have been completed; and, WHEREAS, Soutex Surveyors & Engineers has submitted on behalf of Basco Construction, Inc., Invoice No. 9 and FINAL in the amount of$15,232.70 (attached as Exhibit"D"); NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. No. 18404 7/11/141em Page 2 of 3 THAT, the City Manager is hereby authorized to execute, on behalf of the City of Port Arthur, a Certificate of Acceptance for Basco Construction, Inc., for the County Park and Pioneer Park Concessions Stands project, attached as Exhibit"E"; and THAT, payment shall be made to Basco Construction, Inc., in the amount of $15,232.70 as documented by Invoice No. 9 and FINAL; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
