Comeaux, P.E., Interim City Manager FROM: Susan McDermott, Public Works Director/City Engineer"t DATE: July 25, 2014 RE: Proposed Resolution No. 18445 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18445 which would authorize a professional services agreement between the City and Bob Shaw Consulting Engineers of Port Arthur, Texas, to provide the necessary design and construction phase services for the West 19th Street Drainage Improvements and authorize the City Manager to execute the contract. Amount of the agreement is not-to-exceed $40,000.00, and time of performance will be specified in the contract from the date of the Notice To Proceed issued by the City. BACKGROUND Bob Shaw Consulting Engineers provided a proposal for the design and construction phase services for the West 19th Street Drainage Improvements. Details of the work were set out in their proposal to the City dated May 27, 2014. A copy of the contract will follow. BUDGET/FISCAL EFFECT Funding for this particular project is provided in GO-805 Account 301-1601-591.54-00 in the amount of $40,000. Funds for the construction contract to build the drainage improvements, to be bid after plans are completed, are provided in GO-805 Account 301-1601-591.84-00. SUMMARY I recommend that the City Council approve Proposed Resolution No. 18445 that would authorize a professional services agreement between the City and Bob Shaw Consulting Engineers of Port Arthur, Texas, to provide the necessary design and construction phase services for the West 19th Street Drainage Improvements. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND BOB SHAW CONSULTING ENGINEERS OF PORT ARTHUR, TEXAS, TO PROVIDE THE NECESSARY DESIGN AND CONSTRUCTION PHASE SERVICES FOR THE WEST 19TH STREET DRAINAGE IMPROVEMENTS, IN AN AMOUNT NOT-TO-EXCEED $40,000.00, WITH FUNDING AVAILABLE IN ACCOUNT GO-805 NO 301- 1601-591.54.00 WHEREAS,the City requested Bob Shaw Consulting Engineers of Port Arthur, Texas, to provide a proposal to the City for design and construction phase services for the 19th Street Drainage Improvements; and, WHEREAS, Bob Shaw Consulting Engineers has submitted a proposal, attached as Exhibit"A", for the necessary design and construction phase services for the construction of the North Detention Basin, said proposal being in an amount not-to- exceed $40,000.00 and for a term that will be specified in calendar days from the date of Notice To Proceed with the professional services described herein; and, WHEREAS, this procurement for professional services is authorized pursuant to Section 252.022(4) of the Local Government Code; and, • P.R. No. 18445 7/25/14 sjm Page 2 of 4 WHEREAS, Bob Shaw Consulting Engineers has been selected as the professional of choice because of their demonstrated competence and qualifications in the field as mandated by Government Code Section 2254.002 and 2254.003; and, WHEREAS, funding for the professional services proposed by Bob Shaw Engineers is available in GO-805 Account No. 301-1601-591.54-00; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, the professional services contract between the City and Bob Shaw Consulting Engineers of Port Arthur, Texas, to provide the necessary design and construction phase services for the West 19th Street Drainage Improvements in substantially the same form as attached hereto as Exhibit`B"; and, THAT, the proposed services are in an amount not-to-exceed $40,000.00 and the term of the agreement will be specified in calendar days from the date as stated in the Notice To Proceed issued by the City; and, THAT, a copy of the proposal is attached as Exhibit"A"; and, P.R. Box 1089 Port Arthur, Texas 77641-1089 Re: Proposal for Professional Services 19th Street Drainage Improvements BSCE Job No. CPA-098 Dear Mr. McMahen: We are pleased to submit this proposal to provide Professional Engineering Services for the design of drainage improvements. The proposed project area is located from the upstream end at the east end of 19th Street to the downstream end at Dallas Avenue and 18th Street. I have visited the project area and propose the following scope of services: DESIGN 1. Review available data to include drainage plans, utility maps and as-built drawings. 2. Perform a topographic survey of the project area for use in design and to locate existing utilities. 3. Design drainage improvements and prepare construction plans for the improvements to include location maps, dimensional control, layout sheets, plan and profile sheets, construction details and a stormwater polution prevention plan(SW3P). 4. Incorporate the City's standard construction contract and prepare a complete set of sealed Construction Documents of Plans and Specifications. 5. Provide periodic review sets of construction plans and attend design meetings with the City as necessary during the course of the project. 6. Coordinate the proposed improvements with Jefferson County Drainage District No. 7. 7. Prepare an estimate of probable construction cost. 9. Prepare and submit a pipeline permit application to KCS, including $2,000 processing fee required by the KCS permitting agent. BIDDING& CONSTRUCTION 1. Assist the City in the Bidding Phase by attending pre-bid conferences, issuing addenda as appropriate to interpret, clarify,or expand the bidding documents,advise the City on the acceptability of alternate materials and equipment proposed by prospective contractors. Cost for public notices and advertisements are excluded from the scope. 2. Attend the bid opening and prepare a tabulation of bids received. 3. Conduct a preconstruction conference with the City and Contractor. 4. During Construction,provide necessary interpretations and clarifications of the contract documents as may be needed or as requested by the Owner. 5. Make periodic visits to the site(as distinguished from the continuous service of a resident Project Representative)to observe the progress and quality of the executed work and to determine in general if the work is proceeding in accordance with the Contract Documents. This does not include services required by the KCS permit for Railroad inspection and flagging fees which will be made a part of the construction contract. COMPENSATION $40,000.oo � M The engineering fee and preparatio of the KCS permit and SW3P for the services outlined above shall Not Exceed the sum of$ without prior approval from the City of Port Arthur. We propose to provide these services at out current hourly rates as follows: PROJECT MANAGER $195.00 MANAGER OF ENGINEERING $193.00 RPLS/DESIGNER $145.00 ADMINISTRATIVE ASSISTANT $82.00 AUTOCAD TECHNICIAN $76.00 Page 3 May 27, 2014 Non-labor expense and subcontract expense (if any) at invoice cost plus 10 percent to recover administrative cost. Automobile mileage at $0.56 per mile. Letter and legal size copies at$0.10 per copy. If this proposal is acceptable to the City of Port Arthur,we will prepare and submit a Contract for Professional Services utilizing the City of Port Arthur contract.
