RECOMMENDATION
I recommend that the City Council approve Proposed Resolution No.18468 authorizing the
execution of a contract for a third party energy review for the Phase III Water Loss Reduction
and Water Meter Improvements with Energy & Engineering Solutions, of Roanoke, Texas, in
the amount not to exceed $1,700.00.
BACKGROUND
This contract is to provide services for evaluating the potential energy savings associated with
the following projects: 1) Reduction of water loss through the identification and repair of hydrant
leaks. 2) Large meter replacements; and 3) Automatic metering system upgrades. Energy &
Engineering Solution has submitted a scope of service for the third party energy evaluation,
which will cover the work proposed by Siemens Industry, Inc.
BUDGET/FISCAL EFFECT
This project will be funded from the Utility Operations budget 410-1251-532.54-00.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 18468.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE EXECUTION OF
A CONTRACT FOR A THIRD PARTY ENERGY
REVIEW WITH ENERGY & ENGINEERING
SOLUTIONS OF ROANOKE, TEXAS, IN AN AMOUNT
NOT TO EXCEED $1,700.00; ACCOUNT NO. 410-1251-
532.54-00.
WHEREAS, the Water Utilities Department is in need of a third party review for a utility
assessment for Phase III-Water Loss Reduction and Water Meter Improvements; and,
WHEREAS, the Utility Operations Department, has received a scope of services
(attached as Exhibit"A") for this project, which will assess the water savings and meter accuracy
methodologies for the work that will be completed by Siemens Industry, Inc.; and,
WHEREAS, Energy & Engineering Solutions of Roanoke, Texas, will provide an
evaluation and review of the energy conservation measures identified within the utility
assessment report;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to
execute, on behalf of the City of Port Arthur, a contract between the City of Port Arthur and
Energy & Engineering Solutions, for a third party review for the utility assessment of Phase III-
Water Loss Reduction and Water Meter Improvements, in an amount not to exceed $1,700.00, in
substantially the same form as attached hereto as Exhibit"B"; and,
THAT, this project will be funded by the Utility Operations Budget, 410-1251-532.54-
00; and,
THAT a copy of the caption of this resolution be spread upon the minutes of the City
Council.

Subject: Energy Services-3`d Party Energy Review,City of Port Arthur, Port Arthur,
Texas, Phase III-Water Loss Reduction and Water Meter Improvements
Dear Mr. Comeaux:
Thank you for allowing us the opportunity to submit a proposal for energy services
associated with the above referenced project. The 3rd party energy review will be
focused upon evaluating the potential energy savings associated with the following
projects: 1)Reduction of water loss through the identification and repair of hydrant
leaks, 2)Large Water Meter Replacements,and 3)Automatic Metering System
Upgrades.
We have developed the following scope of services for your review:
Scope of Services
I. 3rd Party Energy Evaluation
1) Review of the Utility Assessment Report as prepared by Siemens.
2) Review the facility improvement measures(FIM's)defined within the UAR as
prepared by Siemens. Compare the approaches recommended to past experience
with similar projects.
3) Review of the water savings and metering accuracy methodologies as provided
within each FIM.
4) Review of the base year water consumption data, and present water rates as
applicable.
5) Review the water meter reading accuracy improvement calculations as
developed by Siemens.
6) Review the projected water savings for each respective energy conservation
measure, and supporting data. Provide any comments, if necessary,associated
with each respective project.
7) Review of the detailed commissioning procedures as outlined within the UAR.
8) Hold discussions with the City of Port Arthur and Siemens representatives to
clarify any outstanding issues, or information provided within the energy report
associated with the energy savings.
9) Provide a summary of findings to the City of Port Arthur Representatives, stating
final recommendations associated with the FIM's and the Utility Assessment
Report.
The above referenced professional engineering evaluation services for item I can be
provided for a lump sum fee of$1,700.00.

II. Assumptions
1) A representative from Siemens will be available to respond to site related
questions. A representative from Siemens will be available to respond to any
project related questions.
2) All of the necessary information required for the energy savings review,
including utility rate information and specific energy conservation measure
details(Pre and Post equipment performance data, energy savings, etc.)will be
provided to Energy&Engineering Solutions in a timely manner.
3) Expenses related to this project have been included in the above referenced fees.
4) The 3rd party energy review will provide an evaluation and review of the energy
conservation measures identified within the Utility Assessment Report.
Additional energy conservation measures can be evaluated if necessary at the
sole discretion of the City of Port Arthur, and will be provided by Energy&
Engineering Solutions as additional services.
5) Site visits are not required to complete the energy savings review and evaluation.
If necessary, site visits can be provided and would be considered as additional
services.

PROFESSIONAL SERVICES AGREEMENT
City of Port Arthur as CLIENT engages Energy&Engineering Solutions,ENGINEER,to perform Professional
Engineering Services for the assignment described as follows:
3RD PARTY ENERGY EVALUATION,WATER LOSS REDUCTION AND LARGE METER REPLACEMENT
REVIEW,PHASE III
CITY OF PORT ARTHUR,TEXAS
I. SERVICES: ENGINEER agrees to perform services in conformance with the following description:
PROFESSIONAL ENGINEERING SERVICES AS OUTLINED IN THE
AUGUST 1,2014 SUBJECT PROPOSAL LETTER
II. COMPENSATION: CLIENT agrees to pay ENGINEER for the above described services in accordance with
the following description:
PROFESSIONAL SERVICES FEE:
ENERGY SAVINGS EVALUATION
LUMP SUM FEE: $1,700.00
III. PAYMENTS: ENGINEER will invoice CLIENT monthly and submit invoicing in the format as established or
agreed upon by CLIENT. CLIENT agrees to promptly pay ENGINEER at his office in Denton
County,Texas,the full amount of such invoice upon receipt.
IV. INSURANCE: ENGINEER agrees to maintain public liability insurance covering claims against ENGINEER
for damages resulting from bodily injury,death or property damage from accidents arising in the course of
services performed under this Agreement. ENGINEER will provide CLIENT evidence of such coverage.
V. LIABILITY LIMITATION: ENGINEER shall have no liability to CLIENT or to others as a consequence of
express or implied approval of any construction activities,for any defective construction(whether or not
observed or approved by ENGINEER),for any excess of construction costs over an amount estimated,or for any
other reason beyond warranty of the use of reasonable skill in the preparation of particular drawings and
designation of particular materials for the assignment covered by this Agreement. In no event shall
ENGINEER'S liability exceed the amount of total compensation received by ENGINEER under this Agreement.
VI. TERMINATION:
A. CONDITIONS OF TERMINATION: This agreement may be terminated without cause at any time prior to
completion of ENGINEER'S services either by CLIENT or by ENGINEER,upon seven days written notice to
the other at the address of record. Termination shall release each party from all obligations of this Agreement,
except as specified in Paragraph VI.B below.
B. COMPENSATION PAYABLE ON TERMINATION: On termination,by either CLIENT or ENGINEER,
CLIENT shall pay ENGINEER the full amount specified in Paragraph II,with respect to any Engineering
Services performed to date of termination(including all reimbursable expenses incurred).
VII. CONFIDENTIALITY: ENGINEER agrees upon receipt of information marked or advised to be proprietary to
not disclose to any other person,firm or corporation,or use for its own benefit and shall use the same degree of
care to avoid publication or dissemination of such information as ENGINEER employs with respect to its own
information which it does not desire to have published or disseminated.
