SUBJECT: Proposed Ordinance No. 5744
RECOMMENDATION
The Purchasing Division recommends the City Council to adopt Proposed
Ordinance No. 5744, authorizing the sale of abandoned property at auction. The proposed
auction will be an online auction.
BACKGROUND
Attached is a list of property that is currently being stored in the Port Arthur
Police Department's Property and Evidence Section. Chief Mark Blanton advised
attempts were made to contact the owner (s) of such property, if known; however, the
attempts were met with negative results. This property is no longer needed in the
prosecution of any cases. Property Bureau (an online auction company) will sell the
abandoned, general merchandise. Proposed Ordinance 5744 authorizes the sale of
equipment and miscellaneous items as detailed in the attached Exhibit "A".
BUDGETARY/FISCAL EFFECT
None
SUMMARY
The Purchasing Division recommends the City Council to adopt Proposed Ordinance No.

ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE SALE OF
ABANDONED PROPERTY BY THE CITY OF PORT
ARTHUR AT A PUBLIC ONLINE AUCTION
WHEREAS, the City of Port Arthur Police Department has abandoned or
unclaimed property as described in Exhibit "A"; and,
WHEREAS, Chief Mark Blanton has advised that attempts were made to contact
the owner(s), if known; of such property, as required by Article 18.17 of the Code of
Criminal Procedure; and
WHEREAS, the attempts to contact the owners were met with negative results; and
WHEREAS, this property is no longer needed in the prosecution of any cases and
Property Bureau will sell the abandoned property via an online auction; and,
WHEREAS, the City's Purchasing Manager has indicated that the fair market value of this
property is less than Five Hundred ($500) per item; and,
WHEREAS, it has been determined it would be in the best interest of the City to sell said
property at an online auction to obtain the best possible price.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager, Purchasing Manager and the Chief of Police
are hereby authorized, by Article 18.17 of the Code of Criminal Procedure to sell the
above named abandoned property at an online auction, said property being shown in
detail on Exhibit "A" attached hereto and made a part hereof.
Section 3. That the above named City officials are hereby authorized and
empowered to execute and deliver bills of sale or other instntments necessary to transfer
title to said items at the price bid.

Section 4. That this being an Ordinance not requiring publication same shall
take effect and be in force immediately from and after its passage.
Section 5. That a copy of the caption of this be spread upon the minutes of the
City Council.
READ, ADOPTED AND APPROVED this day of April, 2007, A.D., at a
Meeting of the City Council of the City of Port Arthur, Texas, by the
