Subject: P.R. No. 14115; Council Meeting of April 24, 2007
Attached is P.R 14115 as it pertains to the development
of approximately 223.26 acres which is bounded by Knauth Road to
the south and extends between West Port Arthur Road and Hebert
Road to the west, adjacent to the Federal Prison. I sent a draft
of this Resolution to the City Attorney of Beaumont. If they
provide any changes or comments, I will let you know at the
council meeting.

RESOLUTION NO.
A RESOLUTION AS IT PERT~Z£NS TO THE DEVELOPMENT
OF A~PROXI~TELY 223.26 ACRES ~r6ICH IS BOUNDED
BY KNAUTH ROAD TO THE SOUTH AND EXTENDS
BETWEENWEST PORT ARTHUR. ROAD AND HEBERT ROAD
TO THE WEST, ADJACENT TO. THE FEDER~tL PRISON
WHEREAS, Roy Breaux owns approximately 223.26 acres which is a
bounded by Knauth Road to the South and extends between West Port
Arthur Road and Hebert Road to the West, adjacent to the Prison
System; and
WHEREA~, approximately 49.26 acres of the Breaux property are
within the City of Port Arthur and is described in Exhibit "A"; and
WHEREAS, approximately 174 acres are in the Extraterritorial
Jurisdiction of the City of Port Arthur; and
WHEREAS, Roy Breaux is planning to develop this 49.26 acre
tract as a Phase I of a residential development, with up to 72
single family residences and possibly a commercial development
adjacent thereto; and
WHEP~AS, Roy Breaux is also considering additional development
for the adjacent 174 acre tract in future phases that could
encompass an additional 312 single family residences
market conditions; and
WHEREAS, the timetable for the filing of plats
development of the subdivision's infrastructure for Phase I
depending on
and the
(roads,
water lines, sewer lines and drainage facilities) is June 30, 2009;
and
WHEREAS, the nearest City of Port Arthur water and sewer lines
are 2.68 miles from this area, and it would cost in excess of
$1,740,110 for the developer Roy Breaux to extend the water and
sewer lines to the nearest Port Arthur facilities; and
WHEREAS, the nearest City of Beaumont water and sewer
lines
are .38 miles from this area and it would cost up to approximately
$395,000 to extend the water and sewer lines to the nearest
Beaumont facilities; and
WHEREAS, it is critical to Southeast Texas to alleviate the
housing shortage; and
WHEREAS, Roy Breaux is requesting to extend water lines from
the planned Phase I residential development to the City of
Beaumont's 18" water line adjacent, to Hebert Road; and
WHEREAS, Roy Breaux is requesting to extend sewer lines from
the planned Phase I residential development to the City of
Beaumont's 12" force main that is already adjacent to Hebert Road;
and
WHEREAS,

this development and to allow Roy Breaux or his
to connect into the sewage and water connections of the
City of Beaumont; and
WHEP~S, the utility lines will be built to either the City of
Port Arthur's specifications or to the City of Beaumont's
specifications, whichever is most the strict; and
WHERF.2%S, Roy Breaux will build valves in the utility lines so
that when and if the City of Port Arthur extends its water and
sewer lines to the area, the City of Port Arthur can take over the
utility system at its discretion; and
WHEP~, the City of Beaumont's Utility Director has indicated
that they do have capacity in their system to serve the new
subdivision as described in Exhibit "A"; and
WHEBF.4%S, the City of Beaumont will benefit therein by the
receipt of additional water and sewer revenue.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2.
That the City of Port Arthur herein consents
to the extension by Roy Breaux of water and sewer lines from the
planned subdivision, as delineated in Exhibit "A", to the City of
Beaumont's water line and sewer iine, as delineated in Exhibit
Section 3.
That this permission is contingent upon all of
the costs of said extension of the water and sewer lines being made
at the expense of Roy Breaux, with said extension being completed
by June 30, 2009.
Section 4. That this permission is contingent upon the
insertion of valves in the utility lines so that when and if the
City of Port Arthur extends its water and sewer lines to the area,
the City of Port Arthur can take over the utility system that is
serving this subdivision at its discretion.
Section 5. That this permission is further contingent upon
the agreement of the City of Beaumont to: (1) allow Roy Breaux to
connect onto its water and sewer utilities as denoted in Exhibit

proposed subdivision as described in Exhibit "A" at published
rates, and (3) maintain water and sewer lines in the public
easements.
Section 6. That a copy of the caption of
