INVOCATION, PLEDGE & ROLL CALL Councilmember Williamson gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Special Session on Tuesday, May 27, 2014 at 3:25 p.m. in the City Council Chamber, City Hall, with the following members present: Mayor Deloris "Bobbie" Prince; Mayor Pro Tem Robert E. "Bob" Williamson; Councilmembers Raymond Scott, Jr., , Elizabeth "Liz" Segler and Willie "Bae" Lewis, Jr.; Interim City Manager John A. Comeaux, P.E., City Secretary Sherri Bellard and City Attorney Valecia Tizeno. Councilmember Elizabeth "Liz" Segler joined the Special Executive Meeting at 4:01 p.m. Councilmember Morris Albright, III. joined the Special Executive Meeting at 4:49 p.m. Councilmember Raymond Scott, Jr. was absent from the Special Executive Meeting. Councilmember Kaprina Frank was absent from the Special Executive Meeting. II. *CLOSED MEETING (EXECUTIVE SESSION) Closed Meeting: (1) Section 551.071 Government Code — To Discuss With The City Attorney Potential Litigation With Texas Gas Service (2) Section 551.087 Government Code — To Discuss Incentives For Commercial, Residential, And/Or Industrial Business Prospects (Zeo Gas LLC) (3) Section 551.072 Government Code — To Discuss The Value Of The Land In The City's Extraterritorial Jurisdiction (ETJ) (4) Section 551.071 Government Code — To Discuss With The City Attorney Potential Litigation As It Pertains To Industrial District Agreements And Legal Issues Related To Potential Tax Abatements (5) Section 551.071 Government Code — To Discuss With The City Attorney Potential Litigation Regarding The Rezoning Of Property At The Former Edison Middle School (Requested By Councilmember Lewis) The City Council recessed their meeting at 3:27 p.m. to meet in Executive Session to consider the above-mentioned topics, and reconvened their meeting at 5:25 p.m. with the following members present: Mayor Prince; Councilmembers Segler, Albright, Lewis and Williamson; Interim City Manager Comeaux; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Blanton. MOTIONS IN OPEN SESSION Authorize The City Manager To Negotiate An I.D.A. With BASF & TOTAL Based Upon The Terms Set Forth By The City Council Wh8ch Includes Additional Incentives For Being Port Arthur Residents. Nested Contractors And The Use Of PABE Businesses Upon the motion of Councilmember Williamson, seconded by Councilmember Alright and carried the above-mentioned motion was adopted. Pleasure Island Director Jimmy Dike appeared before the City Council to answer inquiries. Voting Yes: Mayor Prince; Councilmembers Segler, Albright, Lewis and Williamson. Voting No: None. Authorize The City Attorney To Update The City's Tax Abatement Policy In Conjunction With The Requirements Of Chapter 312 Of The Texas Tax Code Upon the motion of Councilmember Albright, seconded by Councilmember Lewis and carried, the above-mentioned motion was adopted. Voting Yes: Mayor Prince; Councilmembers Segler, Albright, Lewis and Williamson. Voting No: None. Authorize City Manager To Begin Discussions With Zeogas LLC Regarding A Potential Tax Abatement Based Upon The Terms Set Forth By The City Council Upon the motion of Councilmember Albright, seconded by Councilmember Williamson and carried, the above-mentioned motion was adopted. Voting Yes: Mayor Prince; Councilmembers Segler, Albright, Lewis and Williamson. Voting No: None. Authorize The City Attorney To Consult With Tax Abatement Specialist To Review The Policies Related Abatements And IDA's As Set Forth By City Council In An Amount Not-To-Exceed $10,000.00 Upon the motion of Councilmember Albright, seconded by Councilmember Lewis and carried, the above-mentioned motion was adopted. Voting Yes: Mayor Prince; Councilmembers Segler, Albright, Lewis and Williamson. Voting No: None. III. ADJOURNMENT Upon the motion by Councilmember Williamson, seconded by Councilmember Segler and carried unanimously, the City Council adjourned their Special Meeting at 5:239 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
