Tomplait, Assistant Director Utility Operations DATE: August 22, 2014 RE: Proposed Resolution No. 18503 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18503 authorizing the City Manager to execute Change Order No. 5 to the contract for the Gulf Storage Tanks Project with MK Constructors of Vidor, Texas. This change order is a request to increase the contract time by 19 days due to weather delays. BACKGROUND A Hurricane Recovery Grant administered by the Texas General Land Office is funding the majority of this project to replace one GST and construct a second GST & Pump Station at our existing Gulf GST & PS facility on South Gulfway Drive near the Gulf Copper docks. Sabine Pass Liquefaction will fund the portion of this project (about 10%) that was necessary to increase capacity to serve their LNG facility. This project is a major milestone in improving the reliability and capabilities of the public water system serving the Sabine Pass area. It will increase pumping and storage capacity, and provide for an emergency generator to keep water flowing during power outages. This Change Order is for a time extension of 19 days. BUDGET/FISCAL EFFECT None, Project No. I121GST, 144-1201-532.85-00. SUMMARY I recommend that the City Council approve the execution of Proposed Resolution No. 18503. P.R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 5 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND MK CONSTRUCTORS, OF VIDOR, TEXAS, FOR THE GULF STORAGE TANK PROJECT INCREASING THE CONTRACT TIME BY 19 DAYS, PROJECT NO. I21GST,ACCOUNT NO. 144-1201-532.85-00. WHEREAS, per Resolution No. 13-340, the City Council awarded a contract for the Gulf Storage Tanks Project to MK Constructors, of Vidor, Texas; and, WHEREAS, per Resolution No. 13-569, Change Order No. 1 authorized the removal of 100 L.F. of abandoned 6" steel pipe, increasing the total amount by $3,900.00; and, WHEREAS,per Resolution No. 14-125, Change Order No. 2 authorized the removal and plugging of two (2) abandoned 6" oil pipelines that were discovered at the project site and removal and disposal of 3,600 gallons of residual petroleum increasing the contract by $27,650.00; and, WHEREAS, per Resolution No. 14-116, Change Order No. 3 authorized increasing the amount by $6,908.57 to a total of$1,963,358.57 for the substitutions on certain valves requested by the Water Utilities Department for technical reasons; and, WHEREAS, per Resolution No. 14-351, Change Order 4 authorized the relocation of the existing access driveway was needed along with the relocation of existing electrical service, conduit and wiring to provide power to four motor operated valves and a Mag Meter, also for the installation of four remote control stations for the motor operated valves, and to re-construct the steel platform for the additional electrical panels that were missing from the design drawings, this Change Order included an increase by $36,095.00 and a 76 day contract time extension to a P.R. No. 18503 8/22/14 jt Page 2 of 4 new completion date to November 30, 2014; and, WHEREAS, MK Constructors, of Vidor, Texas has requested a time extension of 19 days due to weather delays and delays due to electrical service not installed by Entergy; and, WHEREAS, the project engineer, Arceneaux & Gates Consulting Engineers, Inc., recommends proposed Change Order No. 5 for a time extension of 19 days, attached as Exhibit "A", to accomplish this work; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 5 (attached as Exhibit "A") to the contract between the City of Port Arthur and MK Constructors for an increased time extension of 19 days, bringing the total contract time to 460 days with a new completion date of December 19, 2014; and, THAT, Change Order No. 5 requires no funding by the Project No. I21GST, 144-1201- 532.85-00; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
