RECOMMENDATION
I recommend that the City Council approve Proposed Resolution No. 18509, which would authorize a
requested time extension to the contract between the City and L&L General Contractors for the Tunnel
Demolition, Backfill and Sidewalk Replacement project at 501 Procter Street in conjunction with the
EDC building project at that location,with the requested extension being until November 15,2014.
BACKGROUND
The City contracted with L&L General Contractors for the aforementioned project on April 29, 2014,
with a Notice to Proceed date of June 9, 2014. The project was for a construction time of sixty (60)
calendar days with an expiration date of August 8, 2014. Due to complications and other activities from
Spaw-Glass, the general contractor renovating 501 Procter, as well as other weather and concrete delivery
issues, L&L's work was delayed; however L&L's work was completed as of July 23, 2014. By the time
the final inspection was held,the contract time had expired. The final inspection revealed that about two-
thirds of the sidewalk was not acceptable to our engineer or the contractor, and the contractor asked for a
contract time extension to have the opportunity to remove and replace the sub-par sections of concrete
sidewalk. L&L has officially requested this time extension by letter and our engineer, Arceneaux Wilson
& Cole LLC,has recommended the time extension by letter. The recommended time extension would be
until November 15, 2014 to allow time for L&L to do the necessary work, and to allow time for a final
inspection and project close-out.
BUDGET/FISCAL EFFECT
There is no change in the contract amount as a result of the time extension of the ending date of this
contract since the contractor will be responsible for all costs associated with the replacement of the sub-
par concrete sidewalk sections.
SUMMARY
I recommend that the City Council approve Proposed Resolution No.18509 which would authorize a
requested time extension to the contract between the City and L&L General Contractors for the Tunnel
Demolition, Backfill and Sidewalk Replacement project at 501 Procter Street, with the requested
extension being until November 15, 2014. There will be no additional cost to the City as a result of this
time extension.

A RESOLUTION AUTHORIZING A REQUESTED TIME
EXTENSION TO THE CONTRACT BETWEEN THE
CITY OF PORT ARTHUR AND L&L GENERAL
CONTRACTORS OF BEAUMONT, TEXAS, FOR
TUNNEL DEMOLITION, BACKFILL, AND SIDEWALK
REPLACEMENT ADJACENT TO 501 PROCTER
STREET, SAID TIME EXTENSION BEING UNTIL
NOVEMBER 15,2014.
WHEREAS, per Resolution No. 14-206 dated April 29, 2014, the City entered into a
contract with L&L General Contractors ("L&L") of Beaumont, Texas, for the Tunnel
Demolition, Backfill and Sidewalk Replacement adjacent to 501 Procter Street in the amount of
$45,000.00 and a contract time of sixty (60) calendar days, with an expiration date of August 8,
2014 based on the Notice to Proceed date of June 9, 2014; and,
WHEREAS, due to complications and other activities by Spaw-Glass, the EDC Building
general contractor, and other weather and concrete delivery issues, L&L's work on the tunnel
demolition was delayed, but L&L did complete the work on July 23, 2014; and,
WHEREAS, by the time the final inspection was held, the original contract time had
expired but the appearance of two-thirds of the sidewalk was not acceptable to our engineer or
L&L, and L&L expressed a desire to remove and replace the sub-par sections of the concrete
sidewalk; and,
WHEREAS, L&L has by letter, attached as part of Exhibit "A", requested that the
contract time be extended and our engineer, Arceneaux Wilson & Cole LLC, has by letter,
attached as part of Exhibit "A", recommended that the contract be extended to November 15,
2014, to allow time for L&L to do the necessary work and to allow time for a final inspection
and project close-out.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT, the City Council hereby authorizes a requested time extension to the contract
between the City and L&L General Contractors for Tunnel Demolition, Backfill, and Sidewalk
Replacement, as recommended by Arceneaux Wilson & Cole LLC, to a new ending date of
November 15, 2014, to allow L&L to replace sub-par sections of the concrete sidewalk at their
expense, and to allow a final inspection and project close-out; and,
THAT, a copy of the caption of this resolution be spread upon the minutes of the City
Council.

Dear Mr.Joe Wilson,President Arceneaux Wilson&Cole LLC,
The sidewalk was poured and completed on 7-14-2014,contract expired August 8,2014.
Due to weather related material delays,concrete has been difficult to acquire. This materials delay
combination with an unfamiliar,yet available,concrete crew. Is the main cause of this request. Due to
the uncertainty of concrete, in combination with weather caused us to use a concrete company we weren't
familiar with. There is a section of the concrete side walk we are not happy with.
As a contractor who has a quality relationship with the City of Port Arthur. We did not like the
appearance or condition of 2/3 of the sidewalk and would like the opportunity to remove and replace the
bad sections of concrete.
I would like to request an extension until November 15t11 for final completion and close-out of this
contract.

Dear Mr. McMahen,
GADV Inc. dba L&L General Contractors was awarded the contract for the Tunnel Demolition
and Backfill project on April 29, 2014 with a notice to proceed date of June 9, 2014 and sixty
(60) days to completion. This project is located at 501 Procter St. where Spaw-Glass general
contractors is renovating the existing building to become the new Port Arthur Economic
Development Corporation offices. Due to complications and other activities from Spaw-Glass,
L&L's work on the tunnel demolition project was delayed, however, as of July 23, 2014, the
project was completed. Upon final inspection, after the August 8, 2014 contract expiration date, -
the contractor and engineer did not like the appearance and condition of the sidewalk and would
like the opportunity to remove and replace the sub-par sections of the concrete. We recommend
the original contract be extended to November 15, 2014 to allow L&L General Contractors
enough time to reconstruct the sidewalk.
