RESOLUTION NO.
A RESOLUTION AS IT PERTAINS TO RETAINING DR. BEN KELVIN
STAFFORD FOR THE LOCAL BUSINESS ENTERPRISE PROGRAM, IN
THE NOT-TO-EXCEED AMOUNT OF $20,000.00; FUNDING AVAILABLE
IN THE CITY MANAGER' S CONTINGENCY ACCOUNT NO. 001-1003-
512 .59-00, PROJECT NO. M09002
WHEREAS, on September 17, 2013, the City of Port Arthur
entered into a contract with Dr. Ben Kelvin Stafford pursuant to
Resolution No. 13-433, whereby Dr. Stafford would provide the
following services :
1 . Serve in the capacity of certifying certain Port Arthur
businesses as local businesses for the Port Arthur LBE program
(which includes organizing the advisory board and develop a
document to be used by the local businesses to apply for LBE status
and communicate the application process to all interested parties) ;
and
2 . Serve as a facilitator and member of the grievance board
to address claims from local business concerning the application
criteria.
WHEREAS, the above referred contract will expire on September
16, 2014; however, Dr. Stafford has agreed to continue to act in
this capacity for an additional two (2) year period; and
WHEREAS, it is necessary to continue the duties related to the
Port Arthur LBE program as well as examine some of the compliance
issues related to pending Industrial District Agreements; and

WHEREAS, Dr. Ben Kelvin Stafford has the qualifications to act
in this capacity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1 . That the facts and opinions in the preamble are
true and correct .
Section 2 . That the City Council approves the usage of
Dr. Ben Kelvin Stafford to continue to:
1 . Serve in the capacity of certifying certain Port Arthur
businesses as local businesses for the Port Arthur LBE program
(which includes organizing the advisory board and develop a
document to be used by the local businesses to apply for LBE status
and communicate the application process to all interested parties) ;
2 . Serve as a facilitator and member of the grievance board
to address claims from local business concerning the application
criteria; and
3 . Assist with compliance review at an hourly rate as
delineated in substantially the same form as attached hereto as
Exhibit "A" for a two (2) year period in the not-to-exceed annual
amount of $20, 000 . 00 .
Section 3 . That Dr. Ben Kelvin Stafford will sign the
Resolution agreeing to the terms thereof.
Section 4 . That a copy of the caption of this Resolution
be spread upon the Minutes of the City Council .

Dear Mr. Comeaux:
Re: Letter Agreement
This letter is to confirm my willingness to continue to
work with the Port Arthur Business Enterprise project and to
oversee compliance with Industrial District Agreements.
1 . Seek additional PABE applicants.
2. Serve in the capacity of certifying certain Port
Arthur businesses as local businesses for the Port
Arthur LBE program based upon the existing criteria
(which includes organizing the advisory board and
develop a document to be used by the local businesses
to apply for LBE status and communicate the
application process to all interested parties) .
3. Survey applicants based upon the existing criteria.
4. Survey the current PABE' s to verify participation in

pre-qualification programs.
5. Use the Chamber of Commerce and members of the PABE
Advisory Committee to guide PABE designated companies
through the pre-qualification process.
6. Serve as a facilitator and member of the grievance
board to address claims from local business concerning
the application criteria.
7. Assist review of Quarterly Reports submitted by those
companies which have Industrial District Agreements
with the City of Port Arthur.
8 . Assist review compliance data submitted by those
companies which have Industrial District Agreements
with the City of Port Arthur.
Compensation for the above-listed duties is at an hourly
rate of $85 per hour. This fee will apply to each hour of
billable work plus reasonable expenses, which include the
current state mileage rate for automobile travel.
